8-301. LICENSE REQUIRED; EXCEPTION.
(A) LICENSE REQUIRED.
EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, AN
INDIVIDUAL SHALL BE LICENSED BY THE BOARD BEFORE THE
INDIVIDUAL MAY PRACTICE AS A NURSING HOME ADMINISTRATOR IN
THIS STATE.
(B) EXCEPTION.
(1) IF A LICENSEE LEAVES OR IS REMOVED FROM A
POSITION AS A NURSING HOME ADMINISTRATOR BY DEATH OR FOR ANY
OTHER UNEXPECTED CAUSE, THE OWNER OF THE NURSING HOME OR
OTHER APPROPRIATE NURSING HOME AUTHORITY MAY DESIGNATE AN
ACTING NURSING HOME ADMINISTRATOR, WHO MAY SERVE IN THAT
CAPACITY WITHOUT A LICENSE FOR NOT MORE THAN 90 DAYS.
(2) THE 90-DAY PERIOD BEGINS ON THE DATE THAT
THE LICENSEE LEAVES OR IS REMOVED FROM THE POSITION AS A
NURSING HOME ADMINISTRATOR.
(3) THE BOARD MAY EXTEND THE 90-DAY PERIOD FOR A
FURTHER PERIOD OF NOT MORE THAN 30 DAYS.
REVISOR'S NOTE: Subsection (a) of this section is new
language derived from the second sentence of Art.
43, § 768, as that sentence applies to the
licensing of a nursing home administrator, and
rephrased in the standard language used
throughout this article to state affirmatively
that an individual must be licensed to practice a
health occupation in this State. See also §
8-401 of this title.
Subsection (b) of this section is new language
derived without substantive change from Art. 43,
§ 777.
In subsection (a) of this section, the reference
in present Art. 43, § 768 to the individual being
"registered" is deleted to conform to changes in
terminology made throughout this title. See the
General Revisor's Note to this title.
Also in subsection (a) of this section and
throughout this title, the present references to
a "temporary nursing home administrator" are
deleted as obsolete. In this regard, see the
General Revisor's Note to this title.
Subsection (b)(2) of this section is new language
added to clarify the date when the 90-day period
begins and to conform to the October 26, 1977
unpublished Attorney General's Opinion regarding
present Art. 43, § 777 and addressed to the
