As to subsection (b)(2) of this section, the
present provision in Art. 43, § 770(a)(1) that
the standards "be designed to assure that nursing
home administrators will be ... of good character
and otherwise suitable ... and ... by training or
experience ... qualified to serve as nursing home
administrators" is deleted as redundant of
similar provisions in § 8-302(b) and (d) of this
title.
8-206. ESTABLISHMENT OF FEES; DISPOSITION OF FUNDS.
(A) ESTABLISHMENT OF FEES.
THE BOARD MAY SET REASONABLE FEES FOR THE ISSUANCE AND
RENEWAL OF LICENSES AND ITS OTHER SERVICES.
(B) DISPOSITION OF FUNDS.
THE BOARD SHALL PAY ALL FUNDS COLLECTED UNDER THIS
TITLE INTO THE GENERAL FUND OF THIS STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of Art. 43, § 770(a)(1) and from Art. 43, §
770(c).
Subsection (a) of this section is revised to
clarify the authority of the Board — under its
broad rulemaking powers — to set reasonable fees
for the services for which the fee is not set in
the present law. Although the present law, Art.
43, § 770(a)(1) refers only to the establishment
of fees for "the issuance of licenses and
registrations", it should not be read to preclude
the Board from imposing fees in other appropriate
instances. See, e.g., present Art. 43, § 774,
which refers to a renewal fee.
In subsection (a) of this section, the present
reference to "registrations" is deleted to
conform with changes in terminology made
throughout this title. See the General Revisor's
Note to this title.
As to subsection (b) of this section, the second
sentence of present Art. 43, § 770(c), which
requires that disbursement of funds be in
accordance with Art. III, §§32 and 52 of the
State Constitution and Art. 15A, §§ 1 through 15
of the Code, which relate to disbursements from
the General Fund of this State, is deleted as
implicit in the requirement that the funds are
part of the General Fund of this State.
