(B) UPON THE REQUEST OF A MUNICIPAL CORPORATION TO

PURCHASE ELECTRIC POWER AN ELECTRIC COMPANY SHALL BE

OBLIGATED TO SELL ELECTRIC POWER TO THE MUNICIPAL

CORPORATION AT THE LOWEST AUTHORIZED RATE AVAILABLE TO ANY
OF ITS CUSTOMERS.

(C) A MUNICIPAL CORPORATION MAY PURCHASE, CONSUME,
SELL OR REDISTRIBUTE ELECTRIC POWER UNDER THIS SECTION
WITHIN ITS CORPORATE LIMITS, AND MAY NOT BE DEEMED AN
ELECTRIC COMPANY AS DEFINED IN THIS ARTICLE NOR BE SUBJECT
TO REGULATION BY THE PUBLIC SERVICE COMMISSION FOR THAT
ACTIVITY.

54C.

(A)  All gas and electric companies shall bill their
customers for gas, electricity or any service rendered, on
the basis of the net total cost of the service under the
filed rate applicable thereto. The Public Service
Commission may authorize an additional charge, over the net
total cost, to be applied to any bill or part of a bill not
paid within fifteen (15) days. With respect to residential
customers and residential cooperatives only, the Commission
may authorize an additional charge, over the net total cost,
to be applied to any bill or part of a bill not paid within
20 days. However, any additional charge shall not exceed
five percent (5%) of the net bill or part of the bill and
shall be uniform for all customers, except that different
charges may be imposed on different classes of customers if
approved by the Public Service Commission.

(B) (1) IN THIS SECTION, "INDUSTRIAL PARK" MEANS A
PLANNED DEVELOPMENT PRIMARILY USED FOR INDUSTRIAL OR
COMMERCIAL ENTERPRISES MEETING LOCAL ZONING REQUIREMENTS.

(2) IF AN INDUSTRIAL PARK LOCATED WITHIN A
MUNICIPAL CORPORATION RECEIVES HIGH TENSION PRIMARY SERVICE
FROM MORE THAN ONE ELECTRIC COMPANY, AN OWNER OR TENANT OF
THE INDUSTRIAL PARK MAY PURCHASE THAT POWER FROM THE
ELECTRIC COMPANY SERVICING THE OWNER OR TENANT AT THE LOWER
OF THE RATES CHARGED BY THE ELECTRIC COMPANIES.

SECTION 2. AND BE IT FURTHER ENACTED, That the Public
Service Commission shall investigate the justness and
reasonableness of the rates to all classes of customers
served by the electric companies affected by Section 54C(b)
of Article 78 as added by this Act. The Public Service
Commission shall submit a report of the investigation to the
General Assembly by January 1, 19837

SECTION 3. AND BE IT FURTHER ENACTED, That on July 1,
1983, this Act shall terminate and be of no further force
and effect.
