LAWS OF MARYLAND

Ch. 804

FOR the purpose of providing in the municipal corporation's

expressed powers provisions that a municipal

corporation may buy, sell, and distribution electric
power within its limits; providing that a municipal
corporation has the right to purchase from an electric
company electric power at a certain rate; providing

that upon request of a municipal corporation an

electric company is obligated to sell electric power to
a municipality at a certain rate; providing that a
municipal corporation buying, selling, and distributing
electric power is not an electric company for the
purpose of regulation by the Public Service Commission
that, if certain industrial parks receive high tension
primary service from more than one electric company,
owners or tenants of the industrial parks may purchase
power at the lower of the rates charged; providing for
the termination of this Act; defining a certain term;
and providing for an investigation by the Public
Service Commission.

MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

(9A) TO BUY, SELL, AND DISTRIBUTE ELECTRIC POWER
WITHIN THE LIMITS OF THE MUNICIPAL CORPORATION.

Article 78 - Public Service Commission Law

53A.

(A) A MUNICIPAL CORPORATION HAS THE RIGHT TO PURCHASE
FROM AN ELECTRIC COMPANY ELECTRIC POWER AT THE LOWEST
AUTHORIZED RATE AVAILABLE TO ANY CUSTOMER BEING SERVED BY
THE ELECTRIC COMPANY, FOR USE WITHIN ITS CORPORATE LIMITS.
