Ch. 714

(c) (i) If a member desires to continue his
employment [at the age of 70 years,] AT THE END OF THE
SCHOOL YEAR FOLLOWING THE DATE ON WHICH HE ATTAINS THE AGE
OF 70, the member shall apply for continuation on an annual
basis on a form provided by the Secretary of Personnel. The
member shall submit the application for continuation of
employment not less than 30 nor more than 90 days prior to
[becoming 70 years of age, to the State Board of Education,
the State Superintendent of Schools, or, in the case of
higher education,] THE END OF THE SCHOOL YEAR, to the
member's appointing authority.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

(Senate Bill 237)

AN ACT concerning

Teachers' Retirement and Pension Systems - Retirement Age

FOR the purpose of allowing a member of the Teachers'
Retirement and Pension Systems to remain in service
until the end of the school year following the date
upon which he attains age 70; and generally relating to
the date of retirement of a member of these systems.

BY repealing and reenacting, with amendments,

Article 73B - Pensions

Section 86(1)(b) and (c)(i), and 145(1)(b) and (c)(i)

Annotated Code of Maryland

(1978 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 73B - Pensions

86.

(1) (b) Any member in service who has attained the age
of 70 shall be retired [forthwith provided that with the
approval of the State Board of Education or the State
Superintendent of Schools he may remain in the service
until] AT the end of the school year following the date on
which he attains the age of 70.
