(b) [Any] EXCEPT AS PROVIDED IN PARAGRAPH (C),
ANY member in service who has attained the age of 70 shall
be retired forthwith provided that with the approval of the
State Board of Education or the State Superintendent of
Schools he may remain in the service until AT the end of the
school year following the date on which he attains the age
of 70.
(C) A MEMBER IN SERVICE WHO TEACHES AT A STATE
COLLEGE OR UNIVERSITY OR COMMUNITY COLLEGE AND WHO IS 70
YEARS OLD MAY REMAIN IN SERVICE UNTIL THE END OF THE SCHOOL
YEAR FOLLOWING THE DATE ON WHICH HE BECOMES 70 YEARS OLD.
[(c)] (D) (i) If a member desires to
continue his employment at the age of 70 years END OF THE
SCHOOL YEAR FOLLOWING THE DATE ON WHICH THE MEMBER ATTAINS
THE AGE OF 70, the member shall apply for continuation on an
annual basis on a form provided by the Secretary of
Personnel. The member shall submit the application for
continuation of employment not less than 30 nor more than 90
days prior to becoming 70 years of age THE END OF THAT
SCHOOL YEAR, to the State Board of Education, the State
Superintendent of Schools, or, in the case of higher
education, to the member's appointing authority.
(ii) If the written application for
continuation by the member is, approved by the State Board of
Education, or the State Superintendent of Schools, or, in
the case of higher education, to the member's appointing
authority, employment shall be authorized for 1 year.
Further continuation of employment shall be based on the
execution of the appropriate application form not less than
30 nor more than 90 days prior to the completion of each
authorized year.
(iii) If the written application by the
member is not approved, upon request, the member shall be
given a full hearing before the Maryland Employees
Retirement Review Board pursuant to Section 11(2) of this
article.

(1) (b) [(i) Except as provided in paragraph (ii) any]
ANY member in service who is 70 years old shall be retired
[on the first day of the next calendar month following the
attainment of age 70 provided that with the approval of the
State Board of Education or the State Superintendent of
Schools he may remain in service until] AT the end of the

a State university or college or community college and who
is 70 years old may remain in service until the end of the
school year following the date on which he becomes 70 years
