WHEREAS, This storage capacity would allow the State to
purchase oil in advance of the winter heating season and
thus have a supply backup if the delivery or production of
oil is suddenly disrupted; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

3-112.1. 11-103.

(A)  THE MARYLAND ENVIRONMENTAL SERVICE DEPARTMENT OF
GENERAL SERVICES MARYLAND ENERGY OFFICE SHALL ESTABLISH A
PROGRAM FOR THE STORAGE OF HEATING OIL FOR STATE USE.

(B) (1) THE SERVICE OFFICE, UPON APPROVAL OF THE BOARD
OF PUBLIC WORKS AND AS PROVIDED IN THE STATE BUDGET, SHALL
PURCHASE STORAGE FACILITIES FOR HEATING OIL OR LEASE STORAGE
SPACE IN OIL TANK FARMS.

(2) THE SERVICE OFFICE SHALL CONSIDER THE MOST
ECONOMICAL AND EFFICIENT ALTERNATIVE AVAILABLE.

(C)  THE SERVICE OFFICE MAY SUBLEASE EXCESS STORAGE
CAPACITY, NOT SET ASIDE FOR STATE USE, TO SMALL INNER CITY
JOBBERS.

(D)  STATE AGENCIES SHALL MEET THEIR HEATING OIL
REQUIREMENTS, TO THE FULLEST EXTENT POSSIBLE, THROUGH THESE
FACILITIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
