(House Bill 1048)

AN ACT concerning

Frederick County - Incorporation of Volunteer
Fire and Rescue Organizations

FOR the purpose of providing that proposed incorporations of
volunteer fire or rescue organizations in Frederick
County shall be approved by the Frederick County Board
of Commissioners or a Frederick County municipal
government; providing that the Department of
Assessments and Taxation may not accept articles of
incorporation from volunteer fire or rescue
organizations in Frederick County without accompanying
resolution of approval; and generally relating to
requirements for incorporation of volunteer fire or
rescue organizations in Frederick County.

BY repealing and reenacting, with amendments,

Section 2-102

Annotated Code of Maryland

(1975 Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Corporations and Associations

2-102.

(a)   [In] EXCEPT AS PROVIDED ELSEWHERE IN THIS SECTION,
IN order to form a corporation, one or more adult
individuals acting as incorporators shall:

(1)  Sign and acknowledge articles of
incorporation; and

(2)  File them for record with the Department.

(b) (1) When the Department accepts articles of
incorporation for record, the proposed corporation becomes a
body corporate under the name and subject to the purposes,
conditions, and provisions stated in the articles.

(2) Except in a proceeding by the State for
forfeiture of a corporation's charter, acceptance of the
articles for record by the Department is conclusive evidence
of the formation of the corporation.

(3) THE DEPARTMENT MAY NOT ACCEPT ARTICLES OF
INCORPORATION FROM A FIRE OR RESCUE ORGANIZATION THAT
