BY adding to

Article 41 - Governor - Executive and Administrative

Departments
Section 4A

Annotated Code of Maryland
(1978 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor - Executive and Administrative

Departments

4A.

IF A MEMBER OF A STATE BOARD OR COMMISSION IS CONVICTED
OF A CRIMINAL OFFENSE AS DEFINED BY ARTICLE 38, SECTION   OF
THE CODE AND APPEALS THE CONVICTION, THE BOARD OR COMMISSION
MEMBER SHALL BE SUSPENDED WITHOUT PAY FROM PARTICIPATION IN
THE BOARD'S OR COMMISSION'S ACTIVITIES DURING THE APPEALS
PERIOD.

(A)  IF A MEMBER OF A STATE BOARD OR COMMISSION IS
CONVICTED OF OR ENTERS A PLEA OF NOLO CONTENDERE TO ANY
CRIME WHICH IS A FELONY, OR WHICH IS A MISDEMEANOR RELATED
TO HIS PUBLIC DUTIES AND RESPONSIBILITIES AND INVOLVES MORAL
TURPITUDE FOR WHICH THE PENALTY MAY BE INCARCERATION IN ANY
PENAL INSTITUTION, THE BOARD OR COMMISSION MEMBER SHALL BE
SUSPENDED WITHOUT PAY FROM PARTICIPATION IN THE BOARD'S OR
COMMISSION'S ACTIVITIES DURING THE APPEALS PERIOD. IF THE
CONVICTION BECOMES FINAL, THE MEMBER SHALL BE REMOVED FROM
THE OFFICE AND THE OFFICE SHALL BE DEEMED VACANT.

(B)  IF THE CONVICTION OF THE MEMBER IS REVERSED OR
OTHERWISE VACATED:

(1)  THE MEMBER SHALL BE REINSTATED TO THE OFFICE
FOR THE REMAINDER, IF ANY, OF THE TERM OF OFFICE DURING
WHICH HE WAS SO SUSPENDED OR REMOVED; AND

(2)  ALL PAY AND BENEFITS SHALL BE RESTORED FROM
THE DATE OF THE SUSPENSION OR REMOVAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
