(II) PAY TO THE BOARD AN APPLICATION FEE
OF $25.

(2) AN APPLICATION FOR A FUNERAL ESTABLISHMENT
LICENSE SHALL BE SIGNED BY A LICENSED INDIVIDUAL WHO IS NOT
AN APPRENTICE BUT IS THE OWNER, CO-OWNER, OR FULL-TIME
EMPLOYEE OF THE ESTABLISHMENT TO BE LICENSED.

(C) ISSUANCE.

THE BOARD SHALL ISSUE A FUNERAL ESTABLISHMENT LICENSE
TO A FUNERAL ESTABLISHMENT THAT:

(1)  HAS COMPLIED WITH ALL APPLICABLE STATE AND
LOCAL LAWS; AND

(2)  WILL BE OPERATED IN ACCORDANCE WITH THIS
TITLE BY AT LEAST ONE LICENSED MORTICIAN.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
361(b) through (e).

Present Art. 43, § 361(a), which defines "funeral
establishment", now appears in § 6-101 of this
title.

The second sentence of present Art. 43, § 361(b),
which refers to the license of a funeral
establishment as an additional license, is
deleted as unnecessary.

The Board issues a funeral establishment license
if the Board is satisfied that proper methods of
sanitation, disease control, etc. are observed.
However, at present, there are no standards for
the issuance of this license in either the law or
the rules and regulations of the Board. In
addition, there is no articulation of appropriate
grounds for revocation or suspension of the
license and no express inspection provisions to
enable the Board to ascertain if grounds exist.
This situation is called to the attention of the
General Assembly.

6-311. ISSUANCE AND CONTENTS OF LICENSE; LICENSE NOT
TRANSFERABLE.

(A)  ISSUANCE.

THE BOARD SHALL ISSUE THE APPROPRIATE LICENSE TO AN
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS TITLE.

(B)  CONTENTS.

THE BOARD SHALL INCLUDE ON EACH LICENSE AND RENEWAL
CERTIFICATE THAT THE BOARD ISSUES:
