In subsection (a) of this section, the phrase
"provided by law" is substituted for the phrase
"provided herein" to clarify that provisions
elsewhere in the Code may authorize the practice
of mortuary science in a type of corporate form
e.g., see the provisions on Professional
Service Corporations in Title 5, Subtitle 1 of
the Corporations and Associations Article. The
General Assembly may wish to consider if members
of this occupation were intended to be included
within those provisions.
Also in subsection (a) of this section, the
present reference to a corporation being
"registered" is deleted to conform with changes
in terminology made throughout this title. See
the General Revisor's Note to this title.
In subsection (b) of this section, the broader
language of present Art. 43, § 351(c) is retained
and the first sentence of present Art. 43, §
351(d), which refers to corporations formed
during World War II, is deleted as obsolete since
there are no current licenses issued under that
section.
In subsection (d) of this section, new language
is added to clarify that a licensed corporation
is authorized to "operate a mortuary science
business" and to clarify that any "practice of
mortuary science" that is conducted for the
corporation must be by individuals licensed by
the Board.
As to the renewal of a corporation license, see §
6-313 of this subtitle.
The balance of present Art. 43, § 351(d) now
appears in § 6-401 of this title. The balance of
present Art. 43, §351(e) now appears in § 6-311
of this subtitle.
6-310. FUNERAL ESTABLISHMENT LICENSE.
(A) LICENSE REQUIRED.
A FUNERAL ESTABLISHMENT SHALL BE LICENSED BY THE BOARD
BEFORE THE ESTABLISHMENT MAY BE USED FOR THE PRACTICE OF
MORTUARY SCIENCE.
(B) APPLICATION.
(1) TO APPLY FOR
LICENSE, AN APPLICANT SHALL:
A FUNERAL ESTABLISHMENT
(I) SUBMIT AN APPLICATION TO THE BOARD ON
THE FORM THAT THE BOARD REQUIRES; AND
