SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 78B - Racing Commission

18A.

(d) On and after June 1, 1962, each thoroughbred track
licensee shall provide for the running of races, to be known
as "The Maryland-Bred Fund races". [for horses foaled in
Maryland according to the Maryland Breeders Association
registration certificate.] TO BE ELIGIBLE TO START IN THE
MARYLAND-BRED FUND RACES, EACH HORSE SHALL BE REGISTERED
WITH THE MARYLAND HORSE BREEDERS ASSOCIATION. TO QUALIFY
FOR REGISTRATION, THE HORSE SHALL HAVE BEEN FOALED IN
MARYLAND ACCORDING TO THE MARYLAND HORSE BREEDERS
ASSOCIATION REGISTRATION CERTIFICATE. IN ADDITION, UNLESS
THE HORSE BREEDER HAS MAINTAINED A PLACE OF ABODE IN
MARYLAND FOR MORE THAN 9 MONTHS PRIOR TO REGISTRATION OR
MAINTAINS HIS BREEDING STOCK CONTINUALLY IN MARYLAND THE
HORSE SHALL BE EITHER THE PRODUCT OF A MARE HAVING CONCEIVED
IN MARYLAND THE PREVIOUS SEASON OR THE PRODUCT OF A MARE
HAVING BEEN SENT INTO MARYLAND TO FOAL AND COVERED BY A
MARYLAND STALLION THE SEASON OF THE BIRTH OF THE FOAL. The
number of Maryland-Bred Fund races, amounts of the purses,
dates of running such races, distance provisions of such
races, breeders' awards and any other conditions necessary
to carry out the intent of the Maryland-Bred Fund races
shall be determined by the Commission upon recommendation of
the Committee. The amounts of the purses and the
conditions for each race shall be determined in sufficient
advance time to permit track licensees to include the purses
and the conditions in their stake and condition books. If
any Maryland-Bred Fund race fails to attract at least five
separate qualified entries, then the Commission shall cancel
the race and the purse shall not be paid out of the fund. In
the event the Commission cancels any race, it shall notify
the track licensee in time to permit the licensee to
schedule a substitute race.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
