Article - Natural Resources

10-308.1.

(c) A person may obtain a Maryland migratory wild
waterfowl stamp for a fee of [$1.10] $6.10 $3.10 $3 from the
clerk of the circuit court of any county, or the clerk of
the Court of Common Pleas of Baltimore City, or from any
person designated by the Department. The issuing clerk or
person designated shall retain the sum of 10 cents as
compensation for issuing each stamp. The balance of the fee
is paid over and accounted for [in the same manner as
hunter's licenses.] TO THE STATE TREASURER. THE TREASURER
SHALL CREDIT ALL SUCH FEES RECEIVED TO THE STATE WILDLIFE
MANAGEMENT AND PROTECTION FUND, IN ACCORDANCE WITH § 10-209
OF THIS TITLE.

[(e) (1) All revenues accruing from sales of the
Maryland migratory wild waterfowl stamp, less an amount not
to exceed 10 percent of gross revenue or the actual
administrative costs of producing and distributing the
stamps, shall be expended solely for the propagation or
purchase, and distribution, of mallard or other ducks to be
released pursuant to regulations adopted by the Department.]

(E) (1) ALL REVENUES ACCRUING TO THE WILDLIFE
MANAGEMENT AND PROTECTION FUND FROM SALES OF THE MIGRATORY
WILD WATERFOWL STAMPS SHALL BE EXPENDED SOLELY FOR THE
FOLLOWING PURPOSES:

(I) AN AMOUNT NOT TO EXCEED 10 PERCENT OF
THE NET REVENUE FOR ADMINISTRATION.

(II) THE REMAINING REVENUE SHALL BE

EXPENDED AS DIRECTED BY THE MARYLAND WATERFOWL ADVISORY

COMMISSION AND BUDGETED ANNUALLY BY THE WILDLIFE

ADMINISTRATION FOR:

1. (I) 50 PERCENT FOR PROPAGATION,
PURCHASE, AND DISTRIBUTION OF HAND REARED DUCKS; AND

2.(II) 50 PERCENT FOR WATERFOWL
PROJECTS INCLUDED IN AN APPROVED STATE/PRIVATE COOPERATIVE
PROGRAM TO CREATE, DEVELOP, MAINTAIN, MANAGE, PRESERVE, AND
ENHANCE WATERFOWL/HABITAT IN MARYLAND ON BOTH PRIVATE AND
PUBLIC LANDS. THE COSTS OF EACH WATERFOWL PROJECT ON PRIVATE
LAND APPROVED UNDER THIS SECTION MAY BE COST SHARED WITH THE

OWNER AT A RATE NOT TO EXCEED 50 PERCENT. THE MIGRATORY

WATERFOWL STAMP FUND SHARE ON ANY PROJECT CANNOT EXCEED
$5,000. ANY COST NOT REIMBURSED TO THE LANDOWNER FOR AN

APPROVED WATERFOWL PROJECT SHALL BE CONSIDERED A

CONTRIBUTION TO THE STATE OF MARYLAND. ALL APPROVED

WATERFOWL PROJECTS SHALL BE IMPLEMENTED UNDER A LICENSING

AGREEMENT DETAILING THE LANDOWNER'S RESPONSIBILITIES. THE

COST OF EACH WATERFOWL PROJECT ON STATE LAND APPROVED UNDER
THIS SECTION MAY BE FULLY FUNDED BY THE MIGRATORY WATERFOWL
STAMP FUND. WATERFOWL/HABITAT ON PUBLIC LANDS.
