(iii) "Governing bodies" means [a]:
1. THE MEMBERS OF THE GENERAL
ASSEMBLY WHOSE DISTRICT INCLUDES THE SITE OF THE PROPOSED
LEASE; AND
2. THE county council or county
commissioners; and the municipal councils (by whatever name
known), if any; or the Mayor and City Council of Baltimore
City, AS APPROPRIATE, FOR THE SITE OF THE PROPOSED LEASE.
(2) The Department shall give written notice to
the [appropriate governing bodies in which the property is
located] LOCAL OFFICIALS AND TO THE MEMBERS OF THE GENERAL
ASSEMBLY WHOSE LEGISLATIVE DISTRICT INCLUDES THE SITE OF THE
PROPOSED LEASE concerning the anticipated use of any
facility which it proposes to lease for the first time.
(3) The [governing bodies] LOCAL OFFICIALS
AND MEMBERS OF THE GENERAL ASSEMBLY may submit written
comments to the Department within 30 days after receipt of
the notice.
(4) (I) IF THE NOTICE ISSUED UNDER PARAGRAPH (2)
INCLUDES PROPOSALS FOR MORE THAN ONE SITE, THE DEPARTMENT
SHALL, BEFORE FINALLY SELECTING A SITE, GIVE FURTHER WRITTEN
NOTICE OF THE SITE IT PROPOSES TO SELECT.
(II) THE PROVISIONS OF THIS SUBSECTION
GOVERNING NOTICE, RESPONSE, AND EXECUTION SHALL APPLY TO ANY
SECOND OR LATER NOTICE ISSUED UNDER SUBPARAGRAPH (I) OF THIS
PARAGRAPH.
[(4)] (5) The lease may not be executed until 31
days after notice WITH RESPECT TO NO MORE THAN ONE SITE is
submitted to the [appropriate governing bodies] LOCAL
OFFICIALS AND THE APPROPRIATE MEMBERS OF THE GENERAL
ASSEMBLY.
[(5)] (6) The provisions of this subsection
apply to [all] leases [notwithstanding their] OF ANY
size.
(c) At least 30 days before accepting proposals for
leases, the Department of General Services shall advertise
the State's need for office or building space rental in
daily or weekly newspapers with circulation sufficient to
alert the people of the affected locality or of the State to
the proposed leasing. The advertisement shall announce the
amount of square feet to be leased and the location in which
the State desires to lease the space.
