Article 56 - Licenses

(a) The following acts are prohibited:

(16) THE USE OF A CONFESSED JUDGMENT NOTE,
AUTHORIZING THE HOLDER TO APPEAR IN COURT AND ENTER JUDGMENT
AGAINST THE MAKER IN CASE OF DEFAULT. specifying that the
use of a consumer contract which contains a confessed
judgment clause that waives the consumer's legal defenses is
an unfair or deceptive trade practice and subject to certain
applicable penalties.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 13-301(12) of Article - Commercial
Law, of the Annotated Code of Maryland be renumbered to be
Section(s) 13-301(13).

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

Unfair or deceptive trade practices include any:

(11) Use of any plan or scheme in soliciting
sales or services over the telephone that misrepresents the
solicitor's true status or mission; [or]
