248.

(c) [ (1) The members of the property tax assessment
appeal board shall be removable by the Governor only for
incompetence, malfeasance in office ,CONDUCT UNBECOMING A
BOARD MEMBER, or inability or failure to perform the duties
of office on a regular basis upon recommendation of the
mayor of Baltimore City, the county commissioners or county
council of each county or if the county charter provides for
a county executive, by the county executive with the
approval of the county council after notice and the
opportunity to be heard before such authority of the county
or Baltimore City.]

(1) A MEMBER OF A PROPERTY TAX ASSESSMENT APPEAL
BOARD MAY BE REMOVED FROM OFFICE BY THE GOVERNOR ON THE
GROUNDS OF MISCONDUCT, INCOMPETENCE, MALFEASANCE IN OFFICE,
OR INABILITY OR FAILURE TO PERFORM THE DUTIES OF OFFICE.

(2) THE FOLLOWING ENTITIES MAY RECOMMEND REMOVAL
OF A MEMBER:

(I) THE MAYOR OF BALTIMORE;

(II) IN COUNTIES WITH A COUNTY EXECUTIVE
UNDER THE COUNTY CHARTER, THE COUNTY EXECUTIVE WITH THE

APPROVAL OF THE COUNTY COUNCIL;

(III) IN OTHER COUNTIES, THE COUNTY

COMMISSIONERS OR THE COUNTY COUNCIL; OR

(IV) SUBJECT TO PARAGRAPH (4) OF THIS
SUBSECTION, THE ADMINISTRATOR OF THE PROPERTY TAX ASSESSMENT
APPEALS BOARDS.

(3) BEFORE MAKING A RECOMMENDATION UNDER

PARAGRAPH (2) OF THIS SUBSECTION THE ENTITY SHALL GIVE THE
MEMBER NOTICE AND AN OPPORTUNITY TO BE HEARD.

(4) THE ADMINISTRATOR OF THE PROPERTY TAX
ASSESSMENT APPEALS BOARDS (APPOINTED UNDER § 224A OF THIS
ARTICLE) SHALL MAINTAIN A RECORD OF COMPLAINTS FILED WITH

THE ADMINISTRATOR CONCERNING THE CONDUCT OF A MEMBER. IF

THE ADMINISTRATOR RECEIVES MORE THAN THREE BONA FIDE

COMPLAINTS ABOUT A MEMBER, THE ADMINISTRATOR SHALL INITIATE
PROCEEDINS UNDER PARAGRAPH (3) OF THIS SUBSECTION.

(2) THE ADMINISTRATOR OF THE PROPERTY TAX
ASSESSMENT APPEALS BOARDS SHALL MAINTAIN A RECORD OF
COMPLAINTS CONCERNING THE CONDUCT OR FITNESS OF MEMBERS, AND
SHALL FORWARD COMPLAINTS THAT WOULD JUSTIFY REMOVAL TO THE
APPROPRIATE LOCAL OFFICIALS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
