In subsection (a) of this section, the present
references to types of facility ownership and
types of waste treated are deleted as unnecessary
in light of the definitions of "waterworks",
"wastewater works", and "industrial wastewater
works" in § 20-101 of this title.
In subsection (a)(2) of this section, "Secretary
(of Health and Mental Hygiene)" is substituted
for "Secretary of the Department of Natural
Resources" in light of Ch. 27, Acts of 1980. For
further discussion, see the General Revisor's
Note to this title. This substitution also
conforms to current practice.
In subsection (b) of this section, "person" is
substituted for "corporation or individual" for
clarity.
20-302. QUALIFICATIONS OF APPLICANTS.
(A) IN GENERAL.
THE SECRETARY SHALL ADOPT RULES AND REGULATIONS FOR THE
QUALIFICATIONS OF APPLICANTS.
(B) EDUCATION; EXPERIENCE.
TO QUALIFY FOR CERTIFICATION, THE APPLICANT SHALL MEET
THE EDUCATION AND EXPERIENCE REQUIREMENTS THAT THE SECRETARY
SETS BY RULE OR REGULATION UNDER THIS SECTION.
(C) EXAMINATIONS.
EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE OR THE RULES
AND REGULATIONS ADOPTED UNDER THIS TITLE, THE APPLICANT
SHALL PASS AN EXAMINATION GIVEN BY THE BOARD UNDER THIS
SUBTITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of Art. 43, § 406A(c) — as that
sentence relates to qualifications of applicants
-- and from Art. 43, § 406A(f)(5).
Subsection (c) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to state expressly that if a
certification applicant is required to take an
examination under this subtitle, then the
applicant must pass that examination before the
applicant may be certified.
