REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
406A(f)(l) and (2).
In item (1) of this section, in regard to
industrial wastewater works, the reference to
"Secretary (of Health and Mental Hygiene)" is
substituted for "Secretary of the Department of
Natural Resources" in light of Ch. 27, Acts of
1980. In item (2) of this section, the present
reference to "Secretary of the Department of
Natural Resources" is deleted in light of Ch. 27,
Acts of 1980. These revisions, which conform to
current Board practice, are called to the
attention of the General Assembly. For a further

this title.
SUBTITLE 3. CERTIFICATION OF SUPERINTENDENTS, OPERATORS,
AND INDUSTRIAL OPERATORS.
20-301. CERTIFICATION REQUIRED.
(A) IN GENERAL.
EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, AN
INDIVIDUAL SHALL BE CERTIFIED BY THE BOARD IN AN APPROPRIATE
CLASSIFICATION BEFORE A WATERWORKS, WASTEWATER WORKS, OR
INDUSTRIAL WASTEWATER WORKS MAY EMPLOY THE INDIVIDUAL AS:
(1) A SUPERINTENDENT; OR
(2) AN OPERATOR OR INDUSTRIAL OPERATOR IN A JOB
FUNCTION DETERMINED BY THE SECRETARY.
(B) EXCEPTIONS.
THIS SECTION DOES NOT PREVENT A GOVERNMENTAL AGENCY OR
A PERSON FROM CONTINUING TO EMPLOY IN A WATERWORKS,
WASTEWATER WORKS, OR INDUSTRIAL WASTEWATER WORKS, UNTIL JULY
2, 1982, AN OPERATOR OR INDUSTRIAL OPERATOR WHO IS NOT
CERTIFIED UNDER THIS TITLE.
REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
Art. 43, § 406A(g) — except as (g)(1) relates to
waterworks, wastewater works, and industrial
wastewater works being under the supervision of a
superintendent.
Subsection (b) of this section is new language
derived without substantive change from the
reference to certain prohibitions "after July 1,
1982" in Art. 43, § 406A(g)(2) and (3) and from
the reference to certain permitted activities "on
July 1, 1981" in the first clause of Art. 43, §
406A(h). Therefore, the reference to "until July
2, 1982" is new language added for clarity.
