9-109.

(a) (2) "[Certified] LICENSED psychologist" means a
person who is [certified] LICENSED TO PRACTICE PSYCHOLOGY
under the laws of Maryland.

(3)  "Patient" means a person who communicates or
receives services regarding the diagnosis or treatment of
his mental or emotional disorder from a psychiatrist,
[certified] LICENSED psychologist, or any other person
participating directly or vitally with either in rendering
those services in consultation with or under direct
supervision of a psychiatrist or psychologist.

(d) There is no privilege if:

(4)  The patient, [his] AN authorized
representative OF THE PATIENT, or [his] THE personal
representative OF THE PATIENT makes a claim against the
psychiatrist or [certified] LICENSED psychologist for
malpractice;

Notwithstanding the provisions of Article 59 or the
provisions of any other law, a psychologist [certified]
LICENSED under the "[Psychologists' Certification] MARYLAND
PSYCHOLOGISTS Act" and qualified as an expert witness may
testify on ultimate issues, including insanity, competency
to stand trial, and matters within the scope of that
psychologist's special knowledge, in any case in any court
or in any administrative hearing.

2-205.

(m) (1) With the advice of the State Superintendent,
the State Board shall adopt bylaws, rules, and regulations
for the certification of teachers and other professional
personnel in accordance with this article.

(2)  An individual who is otherwise qualified may
not be denied the right to receive credentials from the
State Board, to receive training to become a teacher, or to
practice teaching in any school because that individual is
totally or partially blind.

(3)  A county board may not refuse to contract
with or engage a teacher because of blindness if the blind
teacher is capable of performing the duties of the position
for which he has applied.

(4)  THE RIGHT OF A SCHOOL PSYCHOLOGIST, WHO IS
CERTIFIED BY THE STATE BOARD TO PRACTICE SCHOOL PSYCHOLOGY
CONSISTENT WITH THE PROVISIONS OF THAT CERTIFICATION, MAY
