HARRY HUGHES, Governor

117

(II) SATISFACTORY EVIDENCE OF COMPLIANCE
WITH THE CONTINUING EDUCATION REQUIREMENTS SET BY THE BOARD
UNDER THIS SECTION FOR LICENSE RENEWAL.

(C)  CONTINUING EDUCATION.

(1)  THE BOARD MAY ESTABLISH CONTINUING EDUCATION
REQUIREMENTS AS A CONDITION TO THE RENEWAL OF LICENSES UNDER
THIS SECTION.

(2)  ANY REQUIREMENTS ESTABLISHED UNDER THIS
SUBSECTION SHALL REFLECT CURRENT EDUCATIONAL METHODS AND
CHIROPRACTIC TECHNIQUES.

(D)  ISSUANCE OF RENEWAL CERTIFICATE.

THE BOARD SHALL RENEW THE LICENSE OF AND ISSUE A
RENEWAL CERTIFICATE TO EACH LICENSEE WHO MEETS THE
REQUIREMENTS OF THIS SECTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
508(a) — except for the last sentence of that
subsection — and (b).

Subsection (d) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article. It states expressly a provision that
presently is only implied in the law: i.e., that
the Board has a duty to renew the license of a
qualified licensee.

Also as to subsection (d) of this section,
present Art. 43, § 508(a) refers to the renewal
document as a "receipt" and present Art. 43, §
506 refers to it as a "renewal certificate". In
this section and throughout this title, the term
"renewal certificate" is substituted for
"receipts" for clarity, uniformity, and to
conform to the practice of the Board.

The Commission to Revise the Annotated Code has
interpreted the law revised under this title as
providing for a license that is not periodic —
i.e., the license does not expire automatically
if the licensee fails to renew by the date
specified. Rather, the license appears to
continue in effect until the Board takes further
action to suspend or revoke it. This
interpretation is derived from the present law as
a whole and from the current practice of the
Board. The nature of the license issued by this
Board is discussed more fully in the General
Revisor's Note to this title. The General
Assembly is invited to consider the distinctive
nature of a license under this title.
