        tobacco in Casqe As pr the decln filed in this Court by
        Michael Earle Attry of the Said Plaintf. May at Large Appeare ~
        And the Said Plaintf. by Richd Macklin his Attry Comes and defends ye. force &ca.
        And Prays leave to Imprle untill next Court which Is granted him the
        Same day is given the Plaintf. also at which Said next Cort the Sd. Cause
        was Contd. untill thes twenty fifth day of August 1702 At Which Sd
        twenty fifth day of August afd Comes the sd Plaintiff by his At afd
        And prays Judgt. for that the Said Defendt. hath not prosecuted filed
        his plea to the decln afd according to the rule of this Court. which being by
        the Enquired of and found to be true it is by them Considered the Same day
        and year that the Said Nicholas Marsey recover agt. the Said Nicholas
        Clouds As well the Sume of Thirteen hundred pounds of good Sound
        Merchantable Leaf tobacco in casqe the debt afd As the Sume of

the Said Phillip did take and ride and evelly intreat and

Other Enormities unto him the Said Phillip did do to

the great damage of him the Said Phillip & Contrary to

the peace &ca.
   And Whereupon the Sd Phillip by Michael Earle his Attry Saith that where
   :as the Said David on the twenty fifth day of August Annoq Domi 1701
   And diverse times as well before as Since In Said County within the Juris:
   :diction of this Court with force and Arms one bay horse of the proper
   goods of him the Said Phillip branded as aforesaid he the Said David
                  opress
   did take ride ^ and evilly intreat And the aforesaid Horse did much Injure
   And harm And other Enormities unto himthe Said Phillip he the Said
   David did do Contrary to the peace &ca. Whereupon the Said Phillip Sayth
   by Means thereof he the worse is and damage hath Sustained to the ~
   value of 1600lb tobo. And thereupon he brings this Suit //
