And the Said David by Richard Macklin his Attry Comes and defends the force and injury When &c: And prays leave to Imprle hereunto untill next Court Which is granted him & Same day is given the Plaintif Also: At which Said next Court being the twenty third day of June the Prties afd by their Attrys afd Appeared and The Cause was thereupon Continued untill next Court ~ ~ Att Which Said next Court to wit the twenty fifth day of August Anno Dmi. 1702 Comes as Well the Said Plaintf. by his Attry Afd As the Said Deft. by his Attry afd who further defends the force & Injury when &c And Says that the afd decln of the afd Phillip as to the taking riding oppressing and evilly intreating the horse afd above in his declaration Set forth that yt. decln in Manner and form afd And the Matter therein Contained doth not hold good in Law to Cause him the Said David to Answer thereunto And that he to yt declaracon in Manner and form afd Expressed hath no need Nor by the Law of the Land is bound to Make Answer thereunto ~ And this he is ready to Aver whereupon for want of A Sufficient Declaration of the afd Phillip And Sufficient Matter in the Same Contained he the Said David Prays Judgt: And his Damages to be Adjudged &ca. // And the Sd. Phillip Saith it is Sufficient &ca. Which Decln demurr and Repln being by the Court heard Weighed and Maturely deliberated It is by them Considered this twenty fifth day of August afd that the Said Phillip Hopkins take Nothing by his Writt afd but be in Mercy for his false Clamr: And that the Said David Morphey Als Wolfrod go thereof with: out day and that The Sd David Morphey recover agt. the Said ~ Phillip Hopkins the Sume of One hundred pounds of tobacco by the Court adjudged unto him for his Costs & Charges in this behalf Laid out and Expended ~ ~~~~~~~~~~~~~~~
