      together with A Copy of the Declaration
        In order for Tryall this Court According to Act of Assembly in
        A plea that he (the Sd. Benjamin) render unto him (the Sd. Edward)
        the full and Just Sume of nine hundred forty two pounds of tobo.
        Good Sound Merchantable leaf tobo. which to him he oweth
        And from him he unjustly detaineth. of which Said writt & Copy
        The Sherf made return that he had taken the body and Served
        the Copy accordingly. Whereupon The Plaintf. by his Attry afd
        Prays that the Said Benjan ye. Deft. May unto his decln Answer
        Which was granted, but for as much as it Appears to this Court
        that the Said Defendt. by himself or his Attry hath not
        filed his plea thereto According to the rules of this Court
           It Is by them Considered this Seventh day of Aprill
        Anno Domi 1702 That the Said Edward recover against the
        Benjamin As well the Sume of nine hundred forty two
        pounds of tobacco the debt afd As the Sume of ——
        two hundred and thirty one pounds of tobo. Cost of Suit And the
        Defendt. in Mercy &ca.

        for that the Said Defendt. hath not filed his plea according
        to the decln afd According to the rules of this Court in Such
        Cases provided ~    Which being by the Justices here enquird
        of And found to be true It is by them Considered (according
        to the prayer of the Sd Plaintf.)    this Seventh day of Aprill
