- tinued from Court to Court untill this p^rsent Court att S^d p^rsent Court to witt this 27^th Daÿ
   of March ann^o Dñi 1705 Comes the Said pltf bÿ his att^rÿ afs^d as allsoe y^e S^d Deft bÿ
   Said att^rÿ who for plea Saith as falloweth viz^t

William Austine	\| and y^e Said William Austine bÿ Benjⁿ Peacke his att^rÿ comes and Defends
ads	\| the force and Injurÿ When &c^a and for plea Saith y^t he y^e Said —
of Jn^o Withington	\| William Did not assume in y^t man^r. and form as y^e Said pltf as
	thus [?] Declared ag^t y^e Said Def^t and of this the Said Def^t putts him
	Selfe upon y^e Countrÿ Peacke p^r y^e Def^t —
	and y^e plt^f in like man^r Earle p^r q^r - - - -

      Thereupon Comãnd is Given to y^e Sher^f of Kent Countÿ y^t he Imediatelÿ Cause
      to Come here twelve &c^a bÿ whom: &c^a who neither &c^a because as well &c^a and y^e S^d
    She^f makes ret^r of his Said p^rcept y^e^SameDaÿ and year and Saith y^t he has here readÿ
      twelve &c^a as bÿ his Said p^rcept his was Comãnded to witt Char^s Wright, Edw^d. Elliott [?]
      Richard, Edw^d. Head, Geo: ffaxon John Loÿde, Peter Green, Will^m. Sweatnam, fflow^r Wallker Phill^p -
      Davis, Steaⁿ Rich, Tho^s Punneÿ who being Duely Ellected trÿed and Sworen to Saÿ y^e truth
      in y^e p^rmisses and haveand [?] all y^e pleading and allegations on both Doe Saÿ upon their ~
      oathes we of y^e Jury Doe find fo^r y^e plt^f in Damages one thousand one hundred —
      Seaventÿ and five pounds of tob^o quallifÿed as afs^d and Cost of Suit
        Therefore It is Considered here bÿ y^e Court this 27^th Daÿ of March ann^o Dñi 1705
      That y^e Said John Withington R^cover ag^t y^e Said William Austine as well Sum^e of
      one thousand one hundred Seaventÿ and five pounds of tobacco y^e Debt fo^r Damages afs^d
      as y^e Sum^e of                                                                        Cost of Suit
      and the Def^t in mercÿ &c^a

a^t	\| William Hollinsworth otherwise Called William W^m Hollinsworth of S^d County
William Hollinsworth	\| plant^r was Sumõned to answer unto Peter Vanbreda Merchant of a plea
	\| ~~of trespass upon the Case~~ y^t he rend^r. unto him ffour hoarses of 3 years old ~
	Each or y^e Sum^e of three thousand pounds of good Sound Merchantable tobacco
	Which to him he oweth and from him unjustlÿ Dataines, as bÿ a Decloⁿ
— - - -	\|filed in this Court bÿ Michael Earle att^rÿ for the S^d pltf ) y^e Same app^rs.

      and the Said Def^t bÿ Benjⁿ Beake his att^rÿ comes and prays leave to Imparle untill
      next Court and hath it y^e Same Daÿ was Given the pltf allsoe att which Said next
      Court this accõn was Continued and it was Continued from Court to Court untill this
      p^rsent Court att which S^d p^rsent Court being on y^e 27^th Daÿ of March anno Dñi
      1705 Comes y^e Said Def^t |and haveing Satisfÿed the Said pltf for y^e Same of fifteen
      hundred pounds of tobacco of y^e Debt afs^d ) fo^r y^e residue of y^e Debt afs^d: being
      fifteen hundred pounds of tobacco, and he is therefore willing y^t be Int^d &c^a
      Which being bÿ y^e Court heard and well understood, It is therefore Con:
   = sidered here bÿ the Justices this 27^th Daÿ of March afs^d that y^e Said Peter —
      Vanbreda recover ag^t the Said William Hollinsworth as well the Sum^e of
      fifteen hundred pounds of tobacco the residue of y^e Debt afs^d as the Sum^e of
                                                                            pounds of tobacco Cost of Suit
                                                                            and the Def^t in mercÿ &c^a
