      William Austine | William Austine of Sd Countÿ planter Stands attached to

| answer unto John Withington of ye Countÿ Schoolmaster of —

  a plea of trespass upon ye Case
      And whereupon ye Sd John bÿ Michae Earle his attrÿ Complaines and Saith yt whereas
      ye John prfesing himselfe a Schoolmaster or an Instructr of youth and to be
      teaching & Instructing of youth in Lettrs and good manners on ye fourth Daÿ of febrÿ anno
      Dñi 1701 in Sd County wthin ye Jurisdiction of this Court a Certaine Comuñication was
      had and moved between ye Sd William and ye Sd John of and Concerning ye Schooling
      or instructing three Children of ye Said Williams for ye tear [?] of two years then
      next Ensueing upon which Comuñnication it was then and there agreed upon &
      accorded to bÿ and between ye Said prtyes yt if in Case ye Said John wo’ld undertake
      to keep his Schoole att a Certaine house near unto one Robt. Marshes plantation on
      Chester River in Said Countÿ being not far Distant from ye Said William’s plantaion
      and take into his Custodÿ or tuition three Children of ye Said Williams and them in Lew of two
      Schoolers |yt is to Saÿ yt he ye Said William Should times Send two of his Said Children and Some=
      times three ) and ym. Instruct in Lettrs. and Good manrs according to ye best of his Skill & cunñing
      And there remaine and Instruct and tutor ye afsd Children for ye time or tearm of two yrs
      from ye time afsd, yt then & asederation [?] thereof ye Sd Wm. upon himselfe assumed & unto ye Sd
      John faithfullÿ prmissed yt he the Sd William wo’ld well and truly pay or Cause to be paid
      unto ye Sd John ye Sume of Sixteen hundred pounds of good Sound merchantable tobo in Cask
      att two Equall paymts yt is to Saÿ ye Sume of Eight hundred pounds as afsd in ye month of Jarÿ
   ye next fallowing ye Date of ye afsd Comunication and ye othe Eight hundred pounds of like tobo
      tobacco in ye month of Jarÿ yn next fallowing ye Said first paymt. and ye Said John in fact
      Saith yt Giveing Creditt to and relying upon ye faire promisses and assumption of ye Sd
      William he ye Said John Did undertake to keep his Schoole att ye house afsd and
      did receive into his tuition Somtimes two and Somtimes three Children of ye Sd Wms.
      and them in lettrs and good manners Did Instruct and each according to ye best of his Skill
      and Cunning and att ye afsd Schoolehouse Did abide and remaine teaching & Instructing
      his Schoolars Dureing ye time and tearm afsd and alhouh [?] ye Said William hath paid an Sa=
    =tisfyed unto ye Said John ye Sume of four hundred twentÿ five pounds of tobacco pt of ye
      Said of Sixteen hundred pounds of tobacco. Yett nevertheless as to ye residue of ye Sd 1600ls
      of tobacco being one thousand one hundred Seaventÿ and five pounds of tobo
      according to his afsd prmiss and assumption unto ye Sd John he hath not paid
      allthoh to Doe ye Same att Chestr afsd on ye ninth Daÿ of March anno Dñi 1703
      and att Divers times as well before as Since he hath been thereunto required butt
      the Same to paÿ he hath Denÿed and refused and Still Doth Denÿ and refuse
      and unjustlÿ Detaine to ye Damãge of ye Said John 2000ls of tobo and thereupon
      he bring This Suit                        Earle pr Qr. Pledges John Doe Rd. Roe
              And the Said William Austine bÿ Benjamen Peacke his attrÿcameand prays
      leave to Imprle untill next Court and he hath it the Same Daÿ
