      att which Said next Court being on y^e fourth Tuesdaÿ in June anno Dñi
      1704 is accõn was Continued untill next Court att which Said next Court
      to witt this 22^th Daÿ of Aug^t anno Dñi 1704 Comes y^e S^d plt^f bÿ
      Att^rÿ afs^d and praÿs y^t y^e S^d Def^t maÿ answer to his Declaⁿ afs^d but y^e
      S^d Def^t Cometh not neither bÿ himselfe or bÿ his att^rÿ but maketh
      Default upon which y^e Court awardeth Judg^t fo^r y^e S^d plt^f for his —
      Debt afs^d and Cost of Suit —
       It is therefore Considered here bÿ y^e Court this 22^th Daÿ of Aug^t an^o Dñi
      1704 That y^e S^d Richard Bennett plt^f recover ag^t y^e S^d Thomas Bostick
      Def^t as well y^e Sum^e of three thousand five hundred thirtÿ & Eight pds
      of tob^o y^e penalltÿ in y^e afs^d Declaⁿ mentioned as y^e Sum^e of two hundred
      Seaventÿ & Six pounds of tobacco Cost of Suit ~

	pounds of tob^o good Sound and merchantable in Cask which to him he ~
	oweth & from him Unjustlÿ Detaines as bÿ a declaⁿ and bill filed
	in this Court ( bÿ Michael Earle y^e S^d pltf’s att^rÿ ) The Same appears

        And y^e S^d Def^t bÿ Chr. Phillipson his att^rÿ Comes and Defends y^e force and Injurÿ
        when &c^a and praÿed leave to Imp^rle untill Next Court which was Granted him y^e
        Same Daÿ was Given y^e plt^f allsoe att w^ch S^d next to witt this 22^th Daÿ of aug^t an^o
        Dñi 1704 Comes y^e S^d pltf bÿ his Said Att^rÿ in p^rsecution of y^e accon afs^d but
        y^e S^d Def Cometh nor fileth anÿ plea in Defence of y^e S^d accõn (according
        to y^e rules of this Court ) neither bÿ himselfe nor bÿ his att^rÿ Whereupon
        This Court awardeth Judg^t for y^e S^d plt^f fo^r Debt afs^d and Cost of Suit
             It is therefore Considered here bÿ this Court this 22^th Daÿ of aug^t an^o Dñi
        1704 y^t y^e S^d pltf recover ag^t y^e S^d Def^t as well y^e Sum^e of five hundred pounds
        of tobacco y^e Debt afs^d as y^e Sum^e of two hundred fiftÿ and one pounds of tob^o

	one of y^e att^rÿs of y^e Same Countÿ Court according to y^e Libertÿes
	and priviledges accustomed &c^a of a plea y^t theÿ render unto him
	full and Just Sum^e of three thousand one hundred and fiftÿ
	pounds of good Sound Merchantable tobacco in Cask w^ch from —
	theÿ unjustlÿ Detaine

        And whereupon y^e S^d Michael in his p^rp^r p^rson in p^rsecution of y^e accon afs^d Saith
        that whereas y^e S^d John in his life time to witt y^e 27^th Daÿ of Ja^rÿ anno Dni 1703
        in S^d Countÿ w^thin y^e Jurisdiction of this Court bÿ his Certaine bond or —
        writeing obligatorÿ Sealed w^th his Seal as his Act and Deed Delivered and
        here in Court brought whose Date is y^e Same Daÿ and year Did acknowledge
        himselfe to be holden and firmlÿ bound unto y^e afs^d Michael in y^e S^d Sum^e
        of 3150^ls of tob^o quallifÿed as afs^d Due to be paid to y^e S^d Michael Earle
        his heires Ex^rs adm^rs: or assignes to y^e w^ch paÿm^t well & truelÿ to be made &
