      three thousand Six hundred ninetÿ & two pounds of good Sound merchantable
      leafe tob^o & Cask: which from him he unjustlÿ Detaines, as p^r y^e rest of
      the Declaⁿ filed in this Court in Due form fullÿ app^rs./
      And now here this 28^th Daÿ of March afs^d comes y^e S^d Def^t & Saÿeth y^t
      he Cañnot Gainsaÿ y^e pltf (in^hisS^d Capicitie) in y^e accon afs^d Soe as afs^d a^t
      him brought. & is therefore willing y^t Judg^t be Intred &c^a
        Which being bÿ y^e Court heard & understood It is bÿ them Considered this
      twentÿ Eight Daÿ of March anno Dñi 1704 y^t y^e S^d Elias King in his afs^d
      Capacitie recover a^t y^e S^d John Whittington as well y^e Sum^e of three thou=
    = sand Six hundred ninetÿ & two pounds of tob^o y^e Debt afs^d as y^e Sum^e of two
      hundred & nineteen pounds of tob^o Cost of Suit & y^e Def^t in mercÿ &c^a

Samuel Taÿlor pltf	\| The S^d pltf brought her majestÿes writt Capias a^t y^e S^d Def^t
a^t	\| for y^e Sum^e of two hundred fiftÿ & Seaven pounds of tob^o
Rob^t. Willkinson	\| and when y^e Daÿ of y^e return of y^e writt Came the Sher^f —
Def^t	\| made retr thereof Endorsed Cepi Corps p^r me Joⁿ Hawkins Sher^f

        and y^e S^d Def^t being held to Baile thereupon fflower Came into Court
        & undertook to baile this accõn according to act of assemblÿ, & thereupon
        The S^d Def^t bÿ Edward Bonwicke his att^rÿ praÿed leave to Imp^rle
        thereunto untill next Court w^ch he had y^e Same was Given y^e pltf
           Att [which Said?] next Court to witt this 28^th Daÿ of March 1704 comes
      the S^d pltf and p^r his Delaⁿ (filed according to y^e rules of this Court bÿ
      Michael Earle his att^rÿ) offers himselfe a^t y^e S^d Def^t in y^e plea of S^d
      but y^e S^d Def^t |allthough Sollemnlÿ Called) Cometh not, neither Doth he
      file anÿ Defence to S^d acc, and Edwd Bonwicke here in Court being
      att^rÿ for y^e S^d pltf Saÿ y^t had noe Instructions from his S^d Clÿent —
      wherebÿ to make anÿ Defence Whereupon y^e S^d pltf bÿ his Said
      att^rÿ praÿs Judg^t &c^a
        Which being bÿ y^e Cour heard It is bÿ y^e Justices Considered here y^e Daÿ & year afs^d
        y^t y^e S^d [illegible] recov^r a^t y^e S^d Rob^t Willkinson as well y^e Sum^e of
        two hundred fiftÿ & Seaven pds of tob^o y^e Cost afs^d as y^e Sum^e of two hund Sixtÿ
        and five pds of tob^o Cost of Suit
