          Whereupon y^e S^d pltf bÿ Richard Macklin his att^rÿ Complaines y^t whereas on
      the 27^th Daÿ of 9ber anno Dñi 1703 att Chester River in Kent Countÿ w^thin y^e Jurisdiction
      of this Court he was Lawfullÿ possessed of one browne baÿ horse w^th white rings
      about his Ears and a Switch Taile of y^e price of two thousand four hundred pds
      of tob^o and being thereof Soe possessed y^e S^d horse out of his possession & hands Causuallÿ
      lost which S^d horse afterwards y^t is to Saÿ y^e 30^th Daÿ of xber then next fallowing att
      Chester River afs^d bÿ findeing to y^e hands & possession of y^e S^d John Came notw^thstand:
    : ing y^e S^d John knowing y^e horse afs^d to be y^e p^r p^r horse of y^e S^d Charles & to y^e S^d Charles
      of right to belonging & appertaine but Craftÿlÿ & fraudulentlÿ Intending y^e S^d Charles in
      that behalfe Cratfÿlÿ & Subtilelÿ to Deceive & Defraud y^e S^d horse to y^e S^d Charles
      tho’ often thereunto requested hath not Delivered but y^e Same horse y^e 30^th Daÿ of xber
      in y^e year afs^d att Chester River afs^d to his prop^r use & p^rfitt Converted & Disposed
      to y^e Cost of y^e S^d Charles 4000^ls of tob^o & thereupon he brings this —

        Th A Coppÿ of y^e Declaⁿ was Sent along w^th y^e writt in this accõn in ord^r for Trÿall
      ag^t this Court accõring to act of assemblÿ) whereof y^e Sher^f makes ret^r Endorsed
      Cepi Corpus p^r me Joⁿ Hawkins Sher^f and y^e S^d Def^t being held to Baile George
      Lumleÿ undertakes to be baile according to act of assemblÿ, Whereupon y^e
      Sd pltf bÿ Edward Bonwick his att^rÿ Comes & Defends y^e force & Enjurÿ when
      &c^a & praÿs Oÿer of y^e pltfs att^rÿ’s power which hath Showen him, & y^e S^d
      Cause Standing for Trÿall according to act as afores^d The S^d Bonwicke Saÿeth
      That he had noe Instructions from his S^d Clÿent Wherebÿ to make anÿ —
      Defence &c^a Whereupon Judg^t is awarded fo^r y^e S^d pltf
           Which being bÿ y^e Court heard & undrstood It is bÿ y^e Justices here Con=
      Sidered this 20^th Daÿ of March 1703 y^t y^e S^d pltf recov^r a^t y^e S^d Def^t as well y^e
      Sum^e of two thousand four hundred pounds of tob^o y^e Debt afs^d as y^e Sum^e of
      two hundred Sixtÿ & nine pounds of tob^o Cost of Suit & y^e Def^t in merÿ &c^a

W^m. Scott	\| The S^d pltf brought Majesties writt of Capias a^t y^e S^d Deft for
a^t	\| y^e Sum^e of 1550^ls of tob^o & when y^e Daÿ of y^e ret^r of y^e writt Came being
Peter Green	\| the 25^th Daÿ of Ja^rÿ 1703 The Sher^f made Retr thereof Cepi Corpus p^r
	\| me John Hawkins Sher^f Whereupon y^e S^d Def^t being held to baile
	Henerÿ Green & Joⁿ Bowles undertook to be Baile according to act of

      assemblÿ & thereupon y^e S^d Def^t bÿ Mÿchael Earle his att^rÿ praÿed leave
      to Imp^rle thereunto untill next Court which he had, y^e Same Daÿ was Given
      the pltf allsoe att w^ch S^d next Court to witt this 26^th Daÿ of March
      anno Dñi 1704 when Comes y^e S^d pltf bÿ Richard Macklin his att^rÿ (& p^r
      his Declaⁿ filed p^r S^d Macklin according to y^e rules of this Court ) & offers ~~him~~
      himself a^t y^e S^d Def^t in y^e plea afs^d, but y^e S^d Michael Earle being att^rÿ
      for y^e S^d Def^t, As afs^d herein Court Saÿeth y^t had noe Instruction from
      his Said Clÿent wherebÿ to make anÿ Defence &c^a Whereupon y^e pltf praÿs
      Judg^t & w^ch he hath
