	to act of assemblÿ and thereupon y^e S^d Def^t praÿed Leave

      To Imparle untill next Court which was Granted him y^e Same Daÿ was Given y^e
      pltf allsoe att w^ch S^d next Court to witt this 28^th Daÿ of March anno Dñi 1704
      y^e S^d pltf Comes |& bÿ his Declaⁿ filed p^r Edward Bonwicke his att^rÿ ) offers him
      Selfe a^t y^e S^d Def^t, Whereupon Rob^t Smith Esq^r Comes in to Court &
      Confesseth Judg^t for y^e Debt afs^d, & Cost of Suit, & to Discount y^e Same w^ch

                It is therefore Considered here bÿ y^e Court the Daÿ & year afs^d y^t y^e S^d
      pltf recov^r a^t y^e S^d Def^t as well y^e Quantitie of three barrells of Corne
      The Debt afs^d as y^e Sum^e of two hundred Sixtÿ & five pds of tobacco Cost
      of Suit & y^e Def^t in mercÿ &c^a

	before y^e Justices of Kent Countÿ Court att next Court then

      fallowing to answer unto Sollomon Wright Guardian of Edmond McDaniel
      of a plea of trespass upon y^e Case,sup>&c^a And when y^e Daÿ of y^e return of
      y^e writt was Come The Sher^f made return thereof Cepi Corps p^r me

           Whereupon y^e S^d Def^t bÿ Richard Macklin his att^rÿ appeared, & y^e S^d
      S^d att^rÿ produceed his warãnt of att^rÿ & thereupon praÿed leave to Imp^rle
      thereunto untill next Court which was Granted him y^e Same Daÿ was —
      Given y^e pltf allsoe, att which S^d next Court to witt this 28^th Daÿ of March
      anno Dñi 1704 when Comes y^e S^d Defen^t bÿ his att^rÿ afs^d as y^e S^d pltf

      Charles Marshall of Kent Countÿ Gent^eman was attached to answ^r unto Sollⁿ
      Wright Guardian of Edmond M^cDaniel of a plea of trespass upon y^e Case
   And whereupon y^e S^d Guardian on behalfe of y^e S^d Edmond M^cDaniel bÿ Edwd Bonwick
   his att^rÿ complaines y^t whereas y^e S^d Edmond M^cDaniel y^e [??] Daÿ of June annoq Dñi 1704 att
   Kent Countÿ w^thin y^e Jurisdiction of this Court was possessed of Certaine beasts (y^tis to Saÿ)
   one Cowe & Calf of y^e price of Eight hundred pds of tob^o two yearlings of y^e price of three
   hundred pounds of ~~three~~ tobacco & one other Cowe & Calfe of y^e price of Eight —
    hundred pounds of tobacco as of his p^rper beasts & Soe being thereof possessed out of
     his hands & possession Causuallÿ lost w^ch beasts afterwards |y^t is to Saÿ ) y^e 20^th Daÿ of
     7ber then next fallowing att Kent Countÿ afs^d w^thin y^e Jurisdiction afs^d, to y^e hands
     & possession of y^e S^d Charles bÿ finding Came not w^thstanding y^e S^d Charles Knowing
     The beasts as afs^d to be y^e proper beasts of y^e S^d Edmond M^cDaniel & of —
     Right to him to belong & app^rtaining Craftÿlÿ & Subtilelÿ to Deceive and
     Defraud y^e S^d Beasts to y^e S^d Edmond nor to y^e S^d Sollomⁿ: Guardian
