      of good Sound merchantable Leave tob^o and Cask w^ch to him he oweth & from
      he unjustlÿ Detaine as bÿ a Declⁿ filed in this Court y^e Same appeãrs
             And Nicholas Comes & Defends y^e force & Enjurÿ |bÿ Michael Earle his att^rÿ )
      when &c^a & praÿed leave to Imp^rle thereunto untill next Court w^ch was Granted
      the Same Daÿ was Given y^e pltf allsoe, att w^ch S^d next Court to witt this 28^th
      Daÿ of March 1704 Comes y^e S^d pltf bÿ Edward Bonwicke his Att^rÿ and offers —
      himselfe a^t y^e S^d Def^t in y^e [plea?] afs^d but y^e S^d Def^t |allthough Solemn:
     :lÿ Called ) Cometh not neither bÿ himselfe nor his Att^rÿ, butt Michael Earle
      y^e S^d Deft^s att^rÿ Saÿeth y^t had noe Instructions from his S^d Clÿent wherebÿ
      to make anÿ Defence, Whereupon y^e S^d pltf praÿs Judg^t &c^a
             Which being bÿ y^e Court heard & understood It is bÿ y^e Justices Consid=
     :red here this 28^th Daÿ of March anno Dñi 1704 y^t y^e S^d pltf recov^r: a^t y^e S^d

      Def as well y^e Sum^e of three hundred^pounds of tob^o the Debt afs^d
      as y^e Sum^e of two hundred & nineteen pounds of tob^o Cost of Suit ——
