      1704 That y^e S^d William Haÿwood pltf recover a^t y^e S^d Thomas Joce Def^t
      as well y^e Sum^e of five pounds Sixteen Shill^gs Ster^g y^e Debt afs^d as y^e Sum^e of
      two hundred twentÿ nine pounds of tobacco Cost of Suit & y^e Def^t in mercÿ &c^a

Mathew Collier	\| Comãnd was Given to y^e Sher^f of Kent Countÿ y^e 29^th of Ja^rÿ 1703
a^t	\| to take John Swettnam if to be found in his Bailewick & him
John Swetnan	\| Safe keep for y^t he have his bodÿ before y^e Justices of Kent
	Countÿ att next Countÿ Court to be held for this Countÿ &c^a
	and copÿ of y^e Declaⁿ being Sent along w^th y^e writt in ord^r. for trÿall
	att this Court according to act of assemblÿ the Sher^f makes

      Whereupon y^e S^d pltf bÿ ~~Richard Macklin his att~~ Edward Bonwicke his
      Att^rÿ Comes & Declares his Casa of accõn att this Court being y^e Court

   Kent Ss) John Swettnam of Kent Countÿ Plantr Stands attached to answ^r
             unto Matthew Collier of a plea of trespass upon y^e Case -  - -
     And whereupon The S^d Matthew bÿ Edward Bonwicke his Att^rÿ complaines that
     whereas y^e S^d Mathew y^e 10^th Daÿ of Maÿ anno Dni 1702 att Kent Countÿ w^thin
     the Jurisdiction of this att y^e Speciall Instance & request of y^e S^d John Swett:
   : nam had Done for y^e S^d John Swettnam Divers Sorts of Smiths work am=
   : ounting to y^e Sum^e of three hundred pounds of tob^o and allsoe att y^e like Instance
     and request of y^e S^d John y^e Daÿ & year afs^d w^th in y^e Jurisdiction afs^d had
     paid unto a Certaine Peter Green one piece of Eight att y^e rate of four
     Shillings & Six pence Ster^g being a Debt Due from y^e S^d Joⁿ: unto y^e S^d Peter
     which S^d work Done & piece of Eight paid as afs^d amõunts in y^e whole
     to y^e Sum^e of three hundred pounds of tob^o & four Shill^gs & Six pence Ster^g
     In Consideration whereof y^e S^d Joⁿ: Swettnam upon himselfe assumed & unto
     y^e S^d Matthew then & there faithfullÿ promised y^t he y^e S^d John when
     thereunto afterwards required y^e afs^d Sum^e of 300^ls of tob^o & 4^s:8^d Ster^g unto
     y^e S^d Matthew he wo’ld well & truelÿ paÿ & Content Yett nevertheless y^e S^d Joⁿ: his
     promiss & assumption afs^d not regarding butt, but plotting Contriveing &
     fraudulentlÿ Intending him y^e S^d Matthew in y^t behalfe Craftÿlÿ & Subtilelÿ
     to Deceive & Defraud y^e afs^d Sum^e of 300^ls of tob^o. unto y^e S^d Matthew altho’
     often thereunto required hath not paid but y^e Same to paÿ hath & Still
     Doth Denÿ & refuse to y^e Damãge of y^e S^d Matthew 600^ls of tob^o. & 9^s: Ster^g
     and thereupon he brings this Suit Bonwicke p^r: q^r: Pledges &c^a Joⁿ Doe R^d Roe
