Thomas Godwin	\| Comãnd was Given to y^e Sher^f of Kent Countÿ y^e 25^th Daÿ of
a^t	\| June anno Dni 1703 to take Jeremiah Miles (adm^r &c^a of
Dollens adm^r - -	\| Benjamin Dollin late of y^e Kingdome of England Deceased ) if
	to be found in ~~Bailewick~~ his Bailewicke and him Safe keep
	Soe y^t he have his bodÿ before y^e Justices of Kent Countÿ Court
	att next Court then fallowing; att w^ch S^d next Court y^e Daÿ of y^e
	return of writt being Come The Sher^f made ret^r hereof —

      Whereupon y^e S^d Def^t appear’d in his prop^r p^rson & praÿed leave to Imp^rle ~
     thereunto untill next Court; & was was Granted him y^e Same Daÿ was Given y^e
     pltf allsoe, att w^ch S^d next Court This accon was Continued, & it was from Court
     to Court untill this p^rsent Court, att w^ch S^d p^rsent Court to witt this 25^th Daÿ of
     Ja^rÿ anno Dni 1703 comes as well y^e S^d Def^t in his prop^r p^rson as y^e S^d pltf
     bÿ Richard Macklin his att^rÿ who Declares as falloweth —

Kent Countÿ	} Jerãmiah Miles adm^r of all and Singular y^e goods & Chattells rights and
	} Creditts of Bej^a Dollen late of y^e Kingdome of England, Deceased Stands attached to
	Thom^s: Godin of a plea of trespass upon the Case —

     And whereupon y^e S^d Tho^s bÿ Richard Macklin his att^rÿ complaines y^t whereas y^e S^d Tho^s y^e 24^th
     Daÿ of aprill anno Dni 1700 att South River w^thin y^e Jurisdiction of this Court att y^e Speciall
     Instance and request of y^e S^d Benja. in his lifetime Shipped on board of y^e Ship Called Anne
     whereof was master for y^e then p^rsent voÿage y^e S^d Bej^a Dollen & then Rideing att —
     Anchor in y^e S^d South River & bound for London one hhd of Marÿland leafe tob^o on y^e
     p^rp^r acc^t & risq of y^e S^d Tho^s: being marked T:G & n^o:1: which S^d one hhd of tob^o y^e S^d Tho^s att
     the afs^d request of y^e afs^d Benjⁿ Consigned to one Rob^t Ruddle & y^e S^d Benjⁿ merchts
     in London or to their assignes Theÿ paÿing fr^eight for y^e Same att y^e rate of Six pds
     p^r tunn w^th Marÿland Duties &c^a In Condraion thereof y^e S^d Benjaⁿ then & there ~~for~~:
     upon himselfe assumed and unto y^e S^d John then & there faithfullÿ p^rmised y^t if y^e
     S^d Ship Called Anne Should Safelÿ arrive at y^e afs^d Port of London y^t then he the S^d
     Benjⁿ together w^th y^e afs^d Ruddle y^e afs^d one hhd of tob^o wo’ld take up & y^e Same well
     & faithfullÿ w^thout fraud or Deceipt Dispose & Sell to y^e best advantage for y^e onleÿ
     use & behoofe of y^e S^d Thomas according to y^e use of Custome of merchants & factors —
     practiced & used in Such Cases & y^e next proceeds of y^e S^d one hhd of tob^o to y^e S^d Thomas
     wo’ld well & truelÿ paÿ & Satsifie, and y^e S^d John in fact Saÿeth y^t alltho^h y^e Ship Called
     Anne in y^e afs^d year 1700 w^th y^e afs^d one hhd of tob^o Soe as afs^d bÿ y^e S^d Thomas on ~
     board y^e Ship freighted Safelÿ arrived att y^e afs^d Port of London & y^e S^d one hhd of
     tobacco to y^e hands of y^e S^d Rob^t & Benjⁿ Safelÿ Came yett y^e S^d Benjⁿ his afs^d
     promiss & assumption little regarding but Deceiveing & fraudulentlÿ Indending y^e S^d
     Thom^s in y^t part to Deceive & Defraud y^e next proceeds of y^e afs^d one hhd of tob^o
     according to his y^e S^d Benj^n’s p^rmiss & assumption y^e S^d Benjⁿ in his lifetime to y^e S^d Tho^s:
     Did not Content & Satisfie nither hath y^e S^d Jeremiah Miles Since y^e Death of y^e S^d —
     Benjⁿ Contented y^e S^d Thomas for y^e Same although often Demanded but y^e Same to Doe
     y^e S^d Jeremiah hath & yett Doth Denÿ, & refuse to y^e Damãge of y^e S^d Thomas 14^ls Ster^g
     and thereupon he bring this Suit       Macklin p^r q^r: Pledges &c^a John Doe Rid Roe
