        this 25^th Daÿ of Ja^rÿ 1703⁴ the y^e S^d Peter Marseÿ recover ag^t y^e S^d Ralph
        Arnald as ell y^e Sum^e of Eighteen Shillings Curent moneÿ of this Province
        as y^e Sum^e of three hundred Seaventÿ & one pounds of tobacco Cost of
        Suit & y^e Def^t in Mercÿ &c^a——       —       —       —

The Ex^r: of ffreÿ	\| Clk of Kent Countÿ Court (Ex^r of y^e last will & Testam^t of
	Edward ffreÿ late of Said Countÿ y^e Deceased) the S^d bill being
	filed upon y^e 27^th Daÿ of Aug^t 1703, The S^d accõn was Continued
	untill next Court and it was Continued from Court to Court
	untill this p^rsent when comes as well y^e S^d Ed Ex^r in his S^d
	Capacitie as y^e S^d pltf bÿ Richard Macklin his att^rÿ who
Kent Ss	read his bill of Complainte viz^t

        Be it remembered y^t y^e 27^th Daÿ of Aug^t Anno Dñi 1703 Came into Court John Davison
        Chÿrorgeon bÿ Richard Macklin his Att^rÿ and Exhibitted to her majestÿes Justices
        of Kent Countÿ Court Judiciallÿ Setting his Certaine bill a^t George Lumleÿ
        Gentⁿ. Clk of of Kent Countÿ Court who is Ex^r of y^e last will & testam^t of Edward
        ffreÿ late of Kent Countÿ (lately Deceased) here p^rsent in Court in his prop^r p^rson
        of a plea of trespass upon y^e Case — as appear’s more att large bÿ ~~y^e Dec~~
        a Declaⁿ filed in this Court, & an acc^t of particulars thereunto Annexed :
           And y^e S^d Pl Def^t in his S^d Capacitie, here in Court in his proper p^rson Con=
        fesseth Judg^t to y^e S^d pltf, y^t is when assetts, of y^e S^d Deceased, Estate in y^e S^d Def^t
        hands is paÿ y^e Same & y^e S^d Def^t in his S^d Capacitie Saÿeth y^t he willing
        y^t Judg^t be Intred a^t him upon y^e Same acc^t
             Which being bÿ y^e Court heard it is bÿ them Considered y^t y^e S^d pltf —
        recover ag^t y^e S^d Def^t in S^d Capacitie as well y^e Sum^e of 1557^ls of Tob^o. y^e
        Debt in y^e pltf’s Declaⁿ & bill Specifÿed as y^e Sum^e of tob^o y^t y^e lawe —
        alloweth for Cost of Suit

a^t	\| Tho: Head who her majesties writt a^t W^m: Hollinsworth of
W^m: Hollinsworth	\| Kent Countÿ of a plea of Trespass upon y^e Case, hath not —
	prosecuted his S^d writt neither filed anÿ Declaⁿ wherebÿ to
	make Appeare his Cause accon —

        Therefore it is Considered here bÿ y^e Court this 25^th Daÿ of Ja^rÿ anno Dñi
        1703⁴ y^t y^e S^d Will^m: Hollinsworth ~~recover ag^t y^e S^d~~ goe thereof —
        w^thout Daÿ &c^a It is likewise Considered y^t y^e S^d W^m. Hollinsworth reco=
     = ver ag^t y^e S^d Thomas Head his Damãges bÿ occasion of y^e p^rmisses
        to two hundred & fourteen pounds of tob^o for his Cost & Charges laid out
        & Expended according to y^e form of y^e Statute & as allsoe y^e Sum^e of 50^ls of tob^o
        for a nonsuit according to act of assemblÿ —————
