a^t	\| of y^e Declaⁿ being Sent w^ch y^e writt in ord^r for trÿall
Ralph Arnald	\| ag^t this Court according to act of assemblÿ y^e Ster^g
	makes ret^r hereof Cepi p^r John Hawkins Sher^g

       Whereupon y^e S^d Def^t appears bÿ himselfe & Edwd Bonwick his att^rÿ &
       the S^d Declaⁿ was read as falloweth
Kent Countÿ } Ss Ralph Arnald of S^d Countÿ Stands attached to answer unto Peter —
in Marÿland } Merseÿ of a plea of trespass upon y^e Case
      And whereupon the S^d Peter bÿ Michael Earle his att^rÿ complaineth & Saith
      that whereas on y^e 19^th Daÿ of 8ber anno Dñi 1701 in S^d Countÿ w^thin y^e Jurisdiction
      of this Court a Certaine Comunication was had & moved between y^e S^d Ralph & the
      S^d Peter of and Concerning a Certaine horse belonging to y^e S^d Ralph y^e was Stray’d
      awaÿ out of y^e possession of y^e S^d Ralph upon which Comunication it was —
      than & there agreed upon bÿ & between y^e S^d parties y^t if he y^e S^d Peter Enquirÿ
      after y^e S^d horse & him find out & an Information or knowledg thereof give to
      y^e S^d Ralph y^t then in Considerãion of his (y^e afs^d Peter’s) Industrÿ & Discoverÿ
      the S^d Ralph upon himselfe assumed, & unto y^e afs^d Peter faithfullÿ p^romissed
      y^t he y^e S^d Ralph wo’ld well & truelÿ Satisfie & paÿ unto him y^e S^d Peter y^e full
      Sum^e of 18^s Ster^g moneÿ of this Province when thereunto afterwards required;
      And y^e S^d Peter in fact Saÿeth y^t Giving Creditt to & relÿing upon y^e fair
      promisses & assumption of him y^e S^d Ralph he y^e S^d Peter Did take paines
      & travell making Enquirÿ for y^e S^d horse & y^e Same horse Did find out &
      Discover, And aknowledge of y^e Same to y^e S^d Ralph Did report, wherebÿ y^e
      Said Ralph came to y^e possession of his Said horse, yett nevertheless y^e S^d
      Ralph his afs^d promiss & assumption before made not regarding but Shifting
      & fraudulentlÿ Contriveing him y^e S^d Peter in this behalfe to Deceive & Defraud
      y^e afs^d 18^s Cur^t moneÿ as afs^d unto y^e S^d Peter he hath not paid although
      often Demanded but y^e Same to paÿ he hath Denÿed & refused & Still
      Doth Denÿ & refuse & unjustlÿ Detaine to y^e Damãge of y^e S^d Peter 36^s
      like moneÿ & thereupon he brings this Suit Earle p^r q^r Pledge^{&c^a} Joⁿ Doe R^d Roe
           And y^e S^d Def^t bÿ his S^d Att^rÿ Comes & Defends y^e force & Injurÿ
      when &c^a & for plea Saÿeth

      Thereupon Cõm is Given to y^e Sher^f of Kent Countÿ y^t he Imediatelÿ
     Cause to Come here twelve &c^a bÿ whome &c^a who neither &c^a to recog=
   = nize because as well &c^a which S^d Sher^f makes an Immediate ret^r
      of his S^d precept &c^a And Saÿeth y^t he hath here readÿ twelve &c^a
