      the one of w^ch three being accimplished y^e other two to Stand voyde and Soe god Send y^e
      Ship to her Desired Port in Safetÿ Dated in Marÿland the 24^th Daÿ of Aprill 1700

            and for plea Saÿeth

           Thereupon Comãnd is Given to y^e Sher^f of Kent Countÿ y^t he Imediatelÿ
      Cause to Come here twelve &c^a bÿ whome &c^a who nither &c^a to recognize because
      as well &c^a and now here this Daÿ to witt y^e Same Daÿ comes y^e S^d Sher^f & make
      return of S^d p^rcept y^t he has here readÿ twelve &c^a as bÿ y^e S^d p^rcept he was —
      Comãnd to witt Robert Dun^e Will^m: Sparkes Geo Powell Nath^ll Cleave Renats Smith Henrÿ —
      Jackson John Richard Rob^t Parkes Rich^d Mason Sam^ll Toveÿ Henrÿ [Morgin?] Edw^d fillingham—
      who being Elelcted, Trÿed & Sworn to Saÿ y^e truth in y^e p^rmisses Doe Saÿ upon their

      as y^e Sum^e of four hund fourtÿ & Eight pounds of tobacco Cost of Suit

Will^m: Hollinsworth -	\| of a plea of trespass upon the Case

           And whereupon y^e S^d John Hawkins bÿ Richard Macklin his att^ry complaines that
      whereas y^e S^d John Hawkins y^e 20^th Daÿ of March anno Dñi 1700 & att Divers Daÿs and
      times afterwards untill y^e 11^th Daÿ of 8ber anno Dñi 1701 att Chester River in Kent
      Countÿ w^thin y^e Jurisdiction of this Court att y^e Speciall Instance & request of y^e S^d
      W^m: Hollinsworth & for y^e proper use & behoofe of y^e S^d W^m: Hollinsworth Sold
      and Delivered unto y^e S^d W^m: Sundrÿ goods warres and merchantdizes & allsoe att y^e
      like Instance & request of y^e S^d Will^m: att Chester River afs^d w^thin y^e Jurisdiction
      afs^d had bÿ his y^e S^d John Hawkins’s Servants John Troulian & John Cremer —
      being Smiths mended Severall Gun Locks & other Utensells of Iron for y^e S^d W^m:
      as bÿ an acc^t thereof to this Declaⁿ annexed & here in Court produced y^e Same —
      app^rs amõunting in y^e whole to y^e Sum^e of Six hundred pounds of tob^o In Condacõn
      thereof the S^d W^m: upon himselfe assumed & unto y^e S^d John Hawkins then &
      there faithfullÿ promised y^t he y^e S^d W^m: when thereunto afterwards y^e afs^d
      Sum^e of 600^ls of tob^o to y^e S^d John Hawkins well & truelÿ he wo’ld paÿ yett
      the S^d Will^m: his promiss & assumption afs^d little minding but plotting Contri=
   : veing & fraudulentlÿ Intending y^e S^d John Hawkins of y^e afs^d 600^ls of tob^o to Deceive
      and Defraud: y^e Same 600^ls of tob^o altho^h often thereunto requested hath not paid
      but y^e Same to paÿ hath & Still Doth Denÿ & refuse to y^e Damãge of y^e S^d John
      Hawkins 1200^ls of tob^o & thereupon he brings this Suit Macklin p^r q^r Pledges &c^a Joⁿ Doe
