John ye 24th Daÿ of Aprill Anno Dñi 1700 att South River wthin ye Jurisdiction of this Court att the Speciall Instance and request of the Said Benjamin in his life time Shipped on board the Ship Called Anne whereof was master for ye then prsent voÿage the Said Benjamin Dollen and then redeing att anchor in the Sd South River and bound for London three hhds of Marÿland leafe tobacco on ye proper acct & Risque of ye Said John being marked which Sd 3 hhds of tobo the Sd John att ye afsd request of ye afsd Benjamin Consigned to one Robert Ruddle & ye Sd Beniamin merchants in London or to their assignes theÿ paÿing fright for ye Same att ye rate of Six pounds prtunn wth Marÿland Duties &ca In Consideration thereof ye Sd Benjamin then & there upon himselfe assumed and unto the Sd John faithfullÿ promissed yt if ye Sd Ship Called Anne Should Safelÿ arrive att ye afsd port of London yt then he ye Sd Benjamin together wth ye afsd Robert Ruddle the afsd Three hhds of tobacco wo’ld take up and ye Same well & faithfullÿ wthout fraud or Decite Dispose & Sell to ye best advantage for ye onelÿ use & behoofe of ye Sd John, according to the use & Custome of Merchants & factors practiced & used in Such Cases & ye next pounds of ye Sd 3 hhds of tobacco to ye Sd John wo’ld well & truelÿ Content & and Satisfie and ye Sd John in fact Saÿeth yt althoh ye Sd Ship Called Anne in ye afsd year 1700 wth ye afsd 3 hhds of tobacco Soe as afsd bÿ ye Sd John on board yeSdShip frighted Did Safelÿ arrive att ye afsd Port of London and ye Sd 3 hhds of tobo to ye hands of ye Sd Ro: & Benjn Safelÿ Came , yett ye Sd Benja his afsd prmiss and assumption little regarding but Deceiveing & fraudulentlÿ Intending ye Sd Jon John Did not Content & Satsifie neither hath ye Sd Jerãmiah Miles Since the Death of ye Sd Benjamin Contented ye Sd John for ye Same althoh often Demanded but ye Same to Doe ye Sd Jera hath & yett Doth refuse to ye Damãge of ye Sd Jon 50 Shipped bÿ the Grace of God in good order & well Conditioned bÿ me Jon: Hamer on mÿ owne acct & Risque in and upon ye good Ship Called the Anne of London whereof is master for this prsent voÿage Bejan: Dollen & now rideing att anchor in South River and bound for London, to Say 3 hhds of Marÿland Leafe tobo being marked & numbrd :1:2:3: afsd port of London (the Danger of ye Seas Excepted ) unto Mr: Robert Ruddle and Binjamin Dollen merchants in London or to their assignes theÿ paÿing freight for the Sd Goods att ye rate of Six pounds pr tune wth Marÿland Dutÿes wth Primage & avarage accustomed, in wittnesse the master or purser of |
