	unto John Haÿmer of a plea of trespass upon the Case

    Whereupon y^e S^d John bÿ Richard Macklin his Att^ry Complaines y^t whereas the Said
     John y^e 24^th Daÿ of Aprill Anno Dñi 1700 att South River w^thin y^e Jurisdiction
      of this Court att the Speciall Instance and request of the Said Benjamin in
      his life time Shipped on board the Ship Called Anne whereof was master for y^e
      then p^rsent voÿage the Said Benjamin Dollen and then redeing att anchor in
      the S^d South River and bound for London three hhds of Marÿland leafe tobacco
      on y^e proper acc^t & Risque of y^e Said John being marked I:H and numbred:1:2:3 –
      which S^d 3 hhds of tob^o the S^d John att y^e afs^d request of y^e afs^d Benjamin ›
      Consigned to one Robert Ruddle & y^e S^d Beniamin merchants in London or to
      their assignes theÿ paÿing fright for y^e Same att y^e rate of Six pounds p^rtunn
      w^th Marÿland Duties &c^a In Consideration thereof y^e S^d Benjamin then & there
      upon himselfe assumed and unto the S^d John faithfullÿ promissed y^t if y^e S^d
      Ship Called Anne Should Safelÿ arrive att y^e afs^d port of London y^t then he y^e
      S^d Benjamin together w^th y^e afs^d Robert Ruddle the afs^d Three hhds of tobacco
      wo’ld take up and y^e Same well & faithfullÿ w^thout fraud or Decite Dispose &
      Sell to y^e best advantage for y^e onelÿ use & behoofe of y^e S^d John, according to
      the use & Custome of Merchants & factors practiced & used in Such Cases & y^e next
      pounds of y^e S^d 3 hhds of tobacco to y^e S^d John wo’ld well & truelÿ Content & —
      and Satisfie and y^e S^d John in fact Saÿeth y^t altho^h y^e S^d Ship Called Anne in y^e
      afs^d year 1700 w^th y^e afs^d 3 hhds of tobacco Soe as afs^d bÿ y^e S^d John on board y^e^SdShip
      frighted Did Safelÿ arrive att y^e afs^d Port of London and y^e S^d 3 hhds of tob^o
      to y^e hands of y^e S^d Ro: & Benjⁿ Safelÿ Came , yett y^e S^d Benj^a his afs^d p^rmiss
      and assumption little regarding but Deceiveing & fraudulentlÿ Intending y^e S^d Joⁿ
      John Did not Content & Satsifie neither hath y^e S^d Jerãmiah Miles Since the Death
      of y^e S^d Benjamin Contented y^e S^d John for y^e Same altho^h often Demanded —
      but y^e Same to Doe y^e S^d Jer^a hath & yett Doth refuse to y^e Damãge of y^e S^d Joⁿ—
      50^ls Ster^g moneÿ & thereupon he brings this Suit Macklin p^r q^r Pledges &c^a Joⁿ Doe Ri: Roe

           Shipped bÿ the Grace of God in good order & well Conditioned bÿ me Joⁿ: Hamer on
      mÿ owne acc^t & Risque in and upon y^e good Ship Called the Anne of London whereof is
      master for this p^rsent voÿage Bejaⁿ: Dollen & now rideing att anchor in South River
      and bound for London, to Say 3 hhds of Marÿland Leafe tob^o being marked & numbrd
IH as in y^e margin; & are to be Delivered in y^e like good order, & well Conditioned att y^e
:1:2:3: afs^d port of London (the Danger of y^e Seas Excepted ) unto M^r: Robert Ruddle
      and Binjamin Dollen merchants in London or to their assignes theÿ paÿing
      freight for the S^d Goods att y^e rate of Six pounds p^r tune w^th Marÿland Dutÿes
      w^th Primage & avarage accustomed, in wittnesse the master or purser
