November Court 1703 Reasons } The pltf ought in his Declan to have Sett forth the price of in Demr } the goods in his Declan alledged to be taken wth bÿ the Deft &ca Issue Joÿned Which Declan plea & Demr being read & heard bÿ the Court here wth all the pleadings and allegations and allegations on both Sides being bÿ them Duelÿ & maturelÿ Considered, The Demr of ye Sd pltf is approved off to be good in Law, And It is bÿ the Court here Considered, this Daÿ to witt ye 23th Daÿ of november anno Dn[i] 1703 that ye Sd Thomas Cooke: take nothing bÿ his writt afsd but be in Mercÿ for his falce Clamour & yt ye Sd Edward Steaphenson goe thereof wthout Daÿ And it is likewise Considered here bÿ ye Court the Daÿ & year afsd that ye Sd Edward Steaphenson recover agt the Sd Tho: Cook as well ye Sume of fiftÿ pounds of tobo for a nonSuit as the Sume of two hundred twentÿ nine pounds of tobo [As?] Cost of Suit laid out & Expended GLumelÿ Clk Kent Countÿ } Ss in Marÿland } Jerãamiah Miles admr of al & Singular the Goods & Chattells rights & Creditts of Benjamin Dollen late of ye Kingdome of Endland Deceased Stands attached to answer unto John ffaining of a plea of trespass upon ye Case And whereupon the Sd John bÿ Michael Earle his Attrÿ Complaines & Saÿth that whereas in ye year of our Lord Christ 1700 the Sd John became Indebted unto him the Sd Benjamin in his life time ye Sume of Elleven hundred pounds of tobacco and being Soe Indebted, att ye Especiall Instance & request of ye Sd Jeremiah on the 15th Daÿ of Augt anno Dni 1702 in Sd Countÿ wthin the Ju= risdiction of this Court who then was admr &ca, that if he ye Sd John wo’ld Ever paÿ unto him the Sd Jeremiah the Sume of three hundred pounds of tobacco over and above the Sd Sume of 1100 ration thereof the Sd Jera upon himselfe assumed & unto ye Sd John faithfullÿ promised that he ye Sd Jerh ye Sd Sume of three hundred pds of tobo |wch apprs bÿ an acct to this Decln annexed & there in Court produced apprs) unto the Sd John he wold well & truelÿ paÿ when thereunto after= wards required and the Sd John in fact Saÿeth that trusting to the faire promisses & assumption afsd of him the Sd Jerh he Did over paÿ unto the Sd Jerh ye Sd Sume of 1300 Satisfÿed unto ye Sd John to paire of Gloves amnounting to ye Sume of Sixtÿ pds of tobo yett nevertheless as to ye residue of ye Sd 300 tobacco being two hundred & fourtÿ pds of tobacco according to his pro= :miss & assumption unto the Sd John he hath not paid although often Demanded but ye Same to paÿ he hath Denÿed & refused & Still Doth Denÿ & refuse & unjustlÿ Detaine to ye Damãge of ye Sd Jon 480 R: R: |
