      two hundred Sixtÿ & one pounds of tobacco In Consideration whereof y^e S^d Ed=
     =ward ffreÿ in his life time upon himselfe assumed & unto y^e S^d Edward Scott
      faithfullÿ promissed y^t he y^e S^d Edward ffreÿ afs^d Sum^e of 14261^ls of tob^o
      unto y^e S^d Edward Scott when thereunto required he wo’ld paÿ & alltho^h y^e S^d Edward
      ffreÿ in his life time paid unto y^e S^d Edward Scott y^e Sum^e of Seaven thousand ~
      Seaventÿ four pounds of tobacco in part of y^e afs^d 14261^ls of tob^o yett as to y^e
      resudie thereof being Seaven thousand & one hundred Eightÿ Seaven pounds
      of tobacco y^e afs^d Edward ffreÿ in his lifetime and y^e afs^d George after y^e
      Death of y^e afs^d Edward ffreÿ y^e promiss & assumption of y^e S^d Edward ffreÿ
      in form afs^d made as to y^e 7187^ls of tob^o or anÿ part thereof
      to y^e S^d Edward Scott have not yett paid but y^e Same to paÿ have Denÿed and
      the S^d George alltho^h often required y^e Same to y^e S^d Edward Scott as yett to paÿ

           This accon being Continued from y^e 22^th Daÿ of June as afs^d untill this
      Daÿ to witt the 28^th Daÿ of Sept^mber an^o 1703 Then Comes y^e S^d Ex^r in S^d Capacitie
      and Saÿeth that he Cannot Gainesaÿ y^e pltf in S^d accon Soe as afs^d brought
      and thereupon Confesseth Judgm^t in his proper person, That is when assetts
      of y^e S^d Deceased’s Estate in his hands to paÿ y^e Same
             It is therefore Considered bÿ y^e Court here this Daÿ & year afs^d y^t
      The S^d pltf recover, ag^t y^e S^d Ex^r in his S^d Capacitie (when assetts as afs^d) as
      well y^e Sum^e of Seaven thousand one hundred Eightÿ & Seaven pounds of tob^o
      the residue afs^d, of y^e Debt afs^d as y^e Sum^e of tob^o (y^t y^e Law alloweth
      in Such Cases for Cost of Suit & the Def^t in Mercÿ &c^a
