      And whereupon the Dainiel bÿ Richard Macklin his Att^rÿ Complaines y^t whereas y^e S^d Andre^w
      the 18^th Daÿ of Aprill Anno Dñi 1702 att Tallbott Countÿ w^thin the Jurisdiction of this
      Court Stood in Debted unto y^e Said in y^e Sum^e of one pound tenn Shillings Ster^g and y^e S^d Andrew
      being Soe Indebted Soe as afs^d Did Draw a Certain note or Script. Signed w^th y^e p^rper
      name of y^e Said Andrew Directed to a certaine Richard Bennett of Tallbott Countÿ req=
      :uesting y^e Said Richard Bennett to paÿ to a certaine Daniel Sherwood y^e Sum^e of 1^ls:10^s:00 Ster^g
      w^ch Said note or Script is here in Court brought, In Consideration thereof y^e Said Andrew upon
      himselfe assumed & to y^e S^d Daniel Sherwood faithfullÿ promissed that if in Case y^e Said
      Richard Beñett Should faile in y^e paÿm^t of S^d Sum^e of 01^ls:10^s: unto him y^e Said Daniel ~
      Sherwood that then he y^e Said Andrew y^e Sum^e of 01^ls:10^s:00 unto y^e Said Daniel Sherwood
      would & truelÿ paÿ when thereunto required and the Said Daniel in fact Saÿeth y^t he
      Did p^rsent y^e S^d note or Script unto y^e Said Richard Bennett requireing of y^e S^d Richd
      the paÿm^t of y^e Said moneÿ in y^e S^d Note Contained, who Utterlÿ refused y^e paÿm^t ~
      Thereof yett nevertheless y^e S^d Andrew y^e to paÿ | according to his afs^d promiss &
      assumption allthough often Demanded hath Denÿed & utterlÿ refused and Still ~
      Doth Denÿ & refuse to y^e Damãge of y^e S^d Daniel Sherwood 3^ls:00^s:00^d & thereupon
      he brings this Suit                           Macklin p^r q^r Pledges Joⁿ Doe R^d Roe

      Whereupon the Said Andrew makes noe appearance neither bÿ himselfe no^r his
      att^rÿ and in Case of non appearance The S^d pltf bÿ his S^d att^rÿ praÿs ~
      Judgm^t w^ch Granted to ~~[illegible]~~ him upon Default:
        Therefore Its Cosidered | bÿ this Court ) here this Daÿ to witt y^e 24^th Daÿ of
      August anno Dñi 1703 That y^e S^d pltf recover ag^t y^e Said Defend^t as well y^e
      Sum^e of one pound tenn Shillings Debt as afs^d as y^e Sum^e of two hundred and –
      fiftÿ Seaven pounds of tob^o Cost of Suit & the Deft in mercy &c^a —

	Declaⁿ filed in this Court \| bÿ Edward Bonwick y^e S^d pltfs Att^rÿ )
	y^e Same (more att large) maÿ appear ~

      And y^e S^d Deft in his prop^r person Comes and Defends y^e force & Injurÿ when &c^a
      and praÿs Lave to Imp^rle hereunto untill next Court, att w^ch Said next Court
      all Causes by being Continued | by y^e Court being adjurned ) untill next ^^Court att w^ch
      S^d next Court (to witt) this twentÿ fourth Daÿ of august año Dñi 1703 here
      Comes y^e Said pltf bÿ his att^rÿ afs^d & offers himself ag^t y^e S^d Def^t in y^e plea
      afs^d but y^e Said Def^t (alltho Solemnlÿ) Called) Cometh not neither bÿ ~
      himselfe or his att^rÿ afs^d | but makes Default ) to make Defeñce in y^e S^d accõn

      Seen, heard, & understood, Its bÿ them Considered that y^e S^d Thomas Snelling
      recover ag^t y^e S^d Andrew Tañard as well y^e Sum^e of four hundred pds ~
      of tob^o y^e D^t afs^d as y^e Sum^e of two hundred ~~thirtÿ five~~ Sixtÿ
      and nine    Cost of Suit & y^e Def^tin mercy &c^a GLumleÿ Clk
