Thomas Tolleÿ |    to answer to John Dowdall of a plea that he reder


     him the full and and Just Sume of four pounds Currant


     moneÿ of this Province which to thim he oweth and


     from him he unjustlÿ Detaines ~
      And whereupon the Said Jon: Dowdall bÿ Richard Macklin his Attrÿ Saith yt
      whereas ye Said Thomas Thomas Tolleÿ ye Eight daÿ of Aprll: anno Dñi 1702
      att Kent Countÿ wthin the Jurisdiction of this Court bÿ his Certaine bill
      or writeing obligatorÿ Sealed wth his Seal as his act & Deed Delivered and here
      into Court brought whose Date is ye Daÿ & year aforesd Did bind himselfe
      to pay or Cause to be paÿd unto ye Sd Jon: Dowdall his heires or assignes ye aforesd
      Sume of four pounds Currant moneÿ of this Province att or upon ye twentieth
      of Maÿ then next Ensueing ye Date of ye Same bill or writeing obligato=
     = rÿ to ye which paÿmt: well & truelÿ to be made & Done the Said Thomas bound
      himself his heires Exrs: and Admrs: bÿ ye Said Writeing obligatorÿ yett notwthstand=
     = ing ye Said Thomas the aforesd Sume of four pound Currant moneÿ according to
      the tenor of the Same bill unto the aforesd Jon: hath not paÿd althou’ ~
      often Demanded but the Same four pound Currant moneÿ hath Denÿed and
      refused and Still Doth Deneÿ and unjustlÿ Detaine to the Damã of ye
      Said Jon: Eight pds of like moneÿ and thereupon he brings this Suit ~

      And here this Daÿ to witt the twentÿ fifth Daÿ of novebr anno Dñi 1702
      Comes the Said Defendt bÿ Edward Boõwick his Attrÿ and Defends the
      force & Injurÿ when &ca and praÿs leave to Imprle thereunto untill next
      Court which is Granted him and the Same Daÿ is Given the plft allsoe
      att which Said next Court to witt the twentÿ Sixth Daÿ of Jarÿ in anno
      Ditto anno Comes the Said parties & appeared to ye Court, And thereupon this
      Cause was Continued untill next Court, att which Sd next Court to witt the
      twentÿ third Daÿ of March anno Dñi 1702/3 the Said prties appear’d —
      againe, and this Cause was farther Continued untill next Court, att wch
      Said next Court to witt on the twentÿ Second Daÿ of June anno Dñi 1703
      Comes againe the Said prties, and this Cause was yett farther Continued ~
      untill next Court, att which Said Next Court to witt this twentÿ fourth
      Daÿ of August anno Dñi 1703 Comes as well the Said plft bÿ his ^Sd attrÿ
      as the Defendt bÿ his Said attrÿ who further Defends ye force & Injurÿ
      when &ca.; & for plea Saÿeth ~    ~~ Nihill Debet pr patriam
                                                                            Bonwick pr Defee ~
           And the aforesd plft bÿ his aforesd attrÿ for replication Saÿes that
      the aforesaid plea of ye aforesd Deft and the matter therein Contain=
      ed is not Sufficient in law to Cause ye Said plft to make answer thereunto ~
      and that he to that plea in manr & form afsd pleaded Canõtnt nor bÿ ye
      lawe of the land is not bound to make answer & this he is readÿ to ~
      verÿfie & thereupon praÿs Judgt for his Dt. afore Said & his Damãges to
      be adjudged unto him
