        Richd: Macklin Attry of the plaintf May Appear~
           And the Said Thomas Scottin in his proper prson Comes —
        into Court And Sayth yt. he Cannot gainsay the plaintf his accõn
        or debt upon Acco. afd and is therefore willing yt. Judgt: be
        Entered agt. him for the Same & Cost of Suit .
                Which being by the Court heard and understood it
        Is by them Considered That the Said Peter Allaby this 25th:
        day of Novr: anno Domi 1702 // Recover against the Sd
        Thomas Scotten as well the Sume of Twelve hundred
        and Sixty pounds of Tobacco the Debt upon Account
        Afd As the Sume of two hundred and fifty Seven———
        pounds of Tobacco cost of Suit and the Deft. in mercy &ca:

      A plea that they render unto him the full and Just Sume of
      three thousand one hundred forty Two pounds of Tobacco in
      casq good Sound and Merchantable which to him they
      Oweth and from him unjustly detaines ~
           And Whereupon the Said Michael Earle in his own prpr
      prson in prosecution of the afd Action Saith that Where
      :as the Said Edward Fry and Edward Stevenson on the twenty
      first day of febry Annoq Dmi 1701 in Said County within
      the Jurisdiction of This Court by their certaine bill or writing
      Obligatory Sealed with the Seales of them the Said Defendts: as their
      Act and deed delivered and here in Court brought whose date is
      the day and year afd did bind themselves their heires Exrs and Ad=
      :mrs. Joyntly and Srãlly to pay or Cause to be paid unto the Said

      Michael his heires Exrs Admrs. Certaine Attry or Assignes the ^ Sume
      of 3141lb tobo. qualifyed as afd convenient in Chester river in Sd -
      County upon demand after the date of the Said Bill Yet Nothwith
      :standing the Said Defendts: nor either of them the Sd Sume of
      3142lb of tobacco according to the tenr. of the Same bill unto the Same
      Michael they have not paid altho often demanded but the Same
      to pay they and evry of them have denyed and refused And Still —
