      Doth deny and refuse and unjustly detaine to the damage of the Sd
      Michael of 6284lb tobo. and thereupon he brings this Suit &ca:

      Defend the force and injury when &ca. and pray leave to Imprle
      hereunto untill next Court which is granted him & the Plf also ~
             Att which Said next Court to wit the twenty third day
      of June Anno Dmi. 1702 The sd. prties Appeared and this Cause was
      thereupon Continued untill next Court At which Sd next
      Court the prties appeared to wit ye. twenty fifth day of
      August 1702 and this Cause was further by this Court —

      Said Parties And this Cause Was yet farther Contd. untill next
      Court At which Said next Court To wit this twenty fifth

      by their Attry afd and offer themselves against the Said Plaintf
      in the plea afd But the Said Michll. Earle altho Solemnly Called
      Cometh not nor doth he prosecute his plea with effect
      whereupon the Defts pray Judgt. &c:
        Which being by the Court understood It is by them
      Considered this twenty fifth day of November afd that the afd
      Michael Earle and his pledges of prosecuting be in mercy &c:
      And that the Names of the pledges be Sought for. And the Sd-
      Edward Fry and Edwd. Stevenson As to the writt afd go thereof wthout
      Day.    And It is likewise Considered by the Said Court that the Sd=
      Fry & Stevenson recover against the Said Michael Earle the Sume
      of One hundred —    -    -    -    ——pounds of tobo. by
      the Court Adjudged unto them for their cost and Charages in —
      this behalf laid out and Expended According to the form Of the
      Statute &ca:
