14) And Whereupon the Said Charles Hollinsworth by Richard Macklin his Attorney Sayth that whereas the Said Isaac Caulk the twenty fifth day of September Anno Domi 1700 at Kent County within the Jurisdiction of this Court by his certain bill or writing obligatory Sealed with his Seale as his act And deed delivered And hereinto Court brought whose date is the day and year afd did bind himself his heires Exrs. and Admrs. to pay or Cause to be pd unto the Said Charles Hollinsworth his certain attorney his heires Exrs. and Admrs. or Assignes the Said Sume of Eleven pounds Sterg currant lawfull mony of England at or upon the first day of August which Should happen in ye. year of our Lord God one thousand Seven hundred and one Yet Never =the less the Said Isaac Caulk the afd Sume of Eleven pounds Sterg currant and Lawfull Mony of England according to the tenr. of the Same bill or writing Obligatory unto the Said Charles Hollinsworth hath not paid but the Same to pay hath denyed and refused and Still doth deny and unjustly detaine to the Damage of the Said Charles twenty two pound. of like Currt. mony And thereupon he brings this Suit ~ Macklin pr Quer plegs. &ca. Jno Doe Rd. Roe ~~ And the Said Defendt. this Twenty fifth day of Novr. Anno Domi 1701 By Michael Earle his Attorney comes and defends the force and injury when &ca. And prays leave to imparle hereunto untill next Court which is granted him the Same day is given the plf also ~ Att Which Said next Court to wit the twenty Seventh day of Janry Anno Domi 1701 Comes the Said plaintf by his Attorney afd And prayth that the Defendant to his decln May Answer. But the Said Defendt. altho’ Solemnly called Cometh not in his proper person, nor by his Attorney to Make defence to the decln afd but makes default. So that the plaintf. Remains agt the Said Defendt. wholly undefended. ~~ Which being by the Court understood It is by them considered this Twenty Seventh day of January afd that the Said Charles Hollinsworth Recover agt. the Said Isaac Caulk the deft.
