13) untill next Court to be held for the Said County which was granted him, the Same
      day was given the plaintiff also ~~

      Make defence to the decln afd but Makes default So that the plaintiffe remains
      against the Said defendant altogether undefended ~~
           Which being by the Justices fully understood it is by them Considered that
      the Sd Michael Earle Plaint recover agt. the sd James Devergee Defendt. as well
      the Sume of four and twenty hundred pounds of tobacco the debt in the
      decln mentioned as also the Sume of two hundred and fifty three
      pounds of Tobacco costs of Suit and the Defendant in Mercy &ca.

John Hollinsworth    | we Command you that you take John Hollinsworth
      of Talbot County planter if he Shall be found in yr. bayliwick and him
      Safe keep So that you have his body before the Justices of our County
      Court to be held at our Court house on chester river on the fourth tues=
      =day of November next to Answer unto John Hawkins and John Boyer
      of a plea of A plea of Trespass upon the case hereof faile not &ca.
           Att which Said next Court To wit the twenty fifth day of Novr. anno
      Domi 1701 came the Said Sherf. and made retn of his Said writt endorsed
      Cepi Corpus, Whereupon the Said John Hollinsowrth defendt, by Michll
      Earle his attorney Appeared and pray’d leave hereof to imparke untill
      next Court which was granted him the Same day was given ye. plfs also
           Att Which Said Next Court to wit the twenty Seventh day of Janry
      Anno Dom 1701 Comes The Said defendt. by his attorney afd and prays
      that, for as much as the Sd plaintiffs by their Attorney afd hath not
      prosecuted their Said Writ with effect in filing a decln according to the rules
                                                                                                                 (thereof
      of this court in Such case provided, The Said Writ may abate & Every clause
           Which being by the Court Enquired of and found to be true, and ye. prmises
      being by them Considered [illegible] It is considered ye. day and year afd that the
      Said Writt of the said plaints do abate And tha the Said Defendant go there
      of without day And that the sd Hollinsworth recover agt. the sd Hawkins &
      Boyer The Sume of two hundred and twenty Eight    pounds of tobo. by ye.
      Court here adjudged unto him for his costs and Charges in this behalf
      laid out and Expanded
