      which Said next Court to wit this twenty Second day of Septr. Anno
      Dmi 1702 Comes the Said Deft. by his Attry afd and offers himself
      ag . the Said Plf. in the plea afd. but the Said Plaintf by himself
      or his Attry doth not Appeare to prosecute ye. accon So as afd brought
           And It is thereupon Considered by the Court here this 22d day of Sepr:
      afd yt. the sd. Robert Smith Esqr. and his pledges Of prosecuting be —
      in Mercy for y . he the sd. Robert hath not prosecuted his Said —
      writt with Effect~ And the Sd Rd. Bishop to go thereof without day
      Smith the Sume of One hundred ————— pounds of tobo:
      for his Costs and Charges in yt: behalf laid out and Expended &ca.

        at |    he take Rennatus Smith of Kent County planter

Rennatus Smith - |    if he Shall be found his bayliwick and him-
      Safe keep So yt. he May have his body before the Justices of
      her Majtys County Court to be held for thes Said County the fourth
      Tuesday of August Next Ensuing to Answer unto Charles Marshll:
      And Anne his wife of A plea that He render them the full Sume
      of three thousand Six hundred and Twelve pounds of tobacco
      which to them he oweth and from them unjustly detains
      And yt. he have then and there this writt &ca
                At Which Said next Court to wit the 25th- day of
      August Anno Domi 1702 the Day of the Retn of the Retn of
      the Said Writt Came John Hawkins high Sherf of Kent County
      And Made retn. thereof Endorsed Cepi pr John Hawkins Sherf
      On which Said day the Said Defendt: by Michael Earle his
                                              leave
      Attry Appeares and prays ^ thereof to Imprle untill the next —
      Court which was granted the Same day is given the plaintf
      Also. And now here at this day to wit the twenty Second day
      of September Anno Dmi: 1702 Comes as well the Said Deft:—
      by his Said Attry As Also the afd plaintf by his Said Attry —
      And the Cause Standing for tryall The plaintifs decln follows vizt:
