      An Appeale from y^e. Judg^t. afd of the Said Court to the next
      prov^ll. Court which is granted they giving Security according
      to Law. Thereupon Comes the Said Charles Marshall and Anne
      his wife Ex^rs. as afd with Robert Smith And Rennatus Smith
      their Sureties And became bound accordingly as p^r the bond filed
      in this Court May Appear~

	Micaj^h Perry & Comp^a:	\| W^m. Deaker of Kent County planter Stands
	a^t	\| Attached to Answer unto Micajah Perry & —
	W^m. Deakers -	\| Comp^a. of A plea of Trespass upon y^e. Case for
		\| the Sume of five hundred pounds of tobacco -

      due upon Account for diverse goods wares and Merchandizes by
      the S^d. plaint^f unto the Said Def^t. Sold and delivered As p^r the
      Declⁿ and Account filed in this Court by Rich^d Macklin Att^ry
            of the plaint^f May at large Appeare
           And the s^d. W^m. Deaker in his proper p^rson appeared &
      pray’d leave to Imp^rle hereunto untill next Co^rt & he hath
      it the Same day is given the plaint^f also at which s^d. next
      Court y^e. S^d parties Appeared and the Cause was Cont^d. untill this
      present Court to wit this twenty Second day of Sept^r. Anno –
      Dmⁱ 1702 when the plaint^fs by their    Att^ry afd Comes and
      prays Judg^t: And the S^d. Def^t. Altho’ Solemnly Called Cometh not
      to make defence to y^e. accon afd but Makes default ~
             Which being by the Court heard and understood it is by
      them Considered this twenty Second day of Sept^r. afd y^t the
      Said Micajah Perry and Comp^a. recover ag^t. the S^d. W^m. Deakers
      As well the Sume of five hundred pounds of tobacco y^e. d^t.
      Afd As the Sume Of two hundred and Eighty nine ——— ——
      pounds of tobacco Cost of Suit and the Def^t. in Marcy &c^a: —

	Rob^t. Smith Esq^r.	\| Command was given the Sher^f of Kent County y^t. he
	a^t	\| take the Body of Rich^d. Bishop of Kent County-
	Rich^d. Bishop:	\| planter and him Safe keep &c^a. to answer unto

      Robert Smith Esq^r. of a plea of Trespass upon the Case &c^a: of which
      Said Writ the Sher^f Made retⁿ. Endorsed Cepi Corpus. And the Said Rich^d.
      Bishop by Rich^d. Macklin his Att^ry comes and defends y^e. force
      And injury when &c^a. And prays leave to Imp^rle untill next
      Court & he hath it the Same day is given the plaint^f Also ~ At
