                                              Septr. Court 1702
      to wit the twentyeth day of August Anno Dmi 1700 At Chester river afd –
      the Said Edward in his life time to his own use did dispose and Convert
      And the said Charles and Anne in their afd Capacities Since the death of
      the Said Edward the Same goods and Chattells to their use Do Convert to ye.
      Damage of the Said Solomon in his afd Capacity fifty four thousand pounds
      Seven hundred fifty Six pounds of tobacco and in delay of the Adndcon of
      the goods and Chattells of the Said James at the time of his death —
      and thereupon he brings this Suit and produceth here in Court his
      letters of Adndcon &ca, Pledges &ca. John Doe Richd. Roe ===
             And the Said Deft. by M Earle his Attry Comes and Defends
      the force and Injury when &ca: And prays leave to Imprle here
      :unto untill next Court which was granted the Same day was
      given the plaintf Also And Now here At this day to wit the
      twenty Second day of Septr. Anno Dmi. 1702 Comes as well the
      Said Defts- by their Attry as also the afd plaintf by his Said
      Attry And the Cause Standing for Tryall The plaintf decln was read
      as abovesd:
    The Admrs. of James Smith    |
             at    |    Not guilty pr patriam    Earle pr Defte
      the Exrs. of Edwd. Smith    |    And the plaintf in like Manner Macklin

             Thereupon Comand is given the Sherf of Kent County yt. he
      immediatly Cause to Come here twelve &ca: by whom &ca. who —
      Neither &ca. to recognize because as well &ca. And now here this —
      day to wit the Same day comes the Said Sherf. and Makes retn. of
      his Said precept yt. he has here ready twelve &ca. As by the
      Said precept it was Commanded to wit Thomas Covington Edward
      Godwin Robt. Ingrum Arthur Miller Thomas Pimey John
      Offley John Ponder Benjan: Ricaud Stephen Whettston John Loyd
      Thomas Godwin & John Meriday Who being Elected Tryed and —
      Sworn to Say the Truth in the prmises do Say upon their oaths
      we of The Jury find for the plaintf which being by the Court
      heard and fully understood    It is Considered by the Said Court—
      that the Said    Solomon Wright Admr. as afd recover agt: the
      Said Charles Marshall and Anne his wife Exrs as afd as Well the
      Sume of twenty Seven thousand three hundred Seventy eight
      pounds of tobacco the debt in the decln menconed as also the Sume
      of Seven hundred pounds of tobacco Cost of Suit and the defendt. in Mrcy &ca.
