           the True and Just Prformance of Thereof The Said Charles bound himself
           his heires Exrs and Admrs. in the Sume of three thousand four hundred
           pounds of the like qualified tobo. by the Said Writing Obligatory yet nothwith
           =Standing the Said Charles The ^Sd Sume of Three Thousand four hundred
           pounds of Tobacco according to the tenr. of the Said bill obligatory unto
           the Said plaintf. did not pay but the Same to pay hath and Still doth deny
           And refuse to the damage of the Said Plaintf. 6800lb tobo. and there
           upon he brings this Suit/    Toaes pr Prsona p[led]ges &ca. Jno Doe Richd. Roe
                And now here at this day to wit the twen[ty] Seventh day of Janry Anno
           Domi 1701 Comes the Said Charles Lowder in his proper prSon into open
           Court and Sayth that as to the Sume of Seventeen hundred and [illegible]
           pounds of Tobacco the Principal debt in the decln mentioned he cannot Say but
           that it is Justly due unto the Said Daniel And is therefore willing that Judgt.
           be entered against him for the Same    Whereupon the Said Daniel
           in open Court releases unto him the penalty of the Same bill ~

                     It is Therefore Considered by the Court here this twenty Seventh
           day of Janry Anno Domi 1702 . That the Said Daniel Toaes Recover
           agt. the Charles Lowder as well the Sume of Seventeen hundred pounds
           of Tobacco the debt afd as also the Sume of two hundred and forty
           five pounds of Tobacco cost of Suit and ye. deft. in Mercy &ca.

      Kent County Ss | James Devergee als dict James Devergee of Sd County gent was Sumoned
      in Maryland       | to Answer unto Michael Earle one of the Attorneys of Said County
                Court according to the liberties and privilidges accustomed of
                A plea that he render unto him the full and Just Sume of four
      and twenty hundred pounds of good Sound Merchantable tobacco and casq
      which to him he oweth and from him unjustly detaines ~
      And Whereupon the Said Michael in his own proper person in prosecution
      of the accon afd Sayth that Whereas the Said James on the twelfth day of
      Febry annoq Domi 1700 in Sd County within the Jurisdiction of this Court
      by his certain bill or writing Obligatory Sealed with his Seale as his act
      and deed delivered and here in Court brought whose date is the Same day
      and year did bind himself his heires Exrs and Admrs. to pay or Cause to be

      qualifyed as afd convenient in Chester river at or upon the tenth day of October
      Next Ensuing the date of the Same bill Yet Notwithstanding the Said James

      the tenr. of the Same bill unto the Said Michael he hath not paid altho’ often
      Demanded but the Same to pay he hath denyed and refused and Still doth
      deny and refuse and unjustly detaine to the damage of the Said Michaell
      4800lb. tobo. and thereupon he brings this Suite Earle pr prSona pleges &ca. Jno Doe R. Roe
      And The Said James Levergee the deft. in his own proper prson comes to
