Rennatus Smith |    the Case for the Sume of three hundred and ninety
        pounds of tobacco due unto the Plaintf by account for ordry
        Accomodations As pr Decln and Account filed in this Court by Richd:
        Macklin Attry of the plaintf May at large appeare. ———
                And the Said Deft. by Michael Earle his Attry Comes
        And defends the force and Injury when &ca. And for prays
        leave to Imprle hereunto untill next Court and he hath it —
        the Same day is given the plaintf Also ——
                Att which Said next Court to wit this twenty Second
        day of Septr. Anno Dmi. 1702 Comes as well the Said Plf
        by his Attry afd as the Said Defendt: by his Attry who
        further defends the force and Injury when &ca. And for
        plea Sayth that the plaintf his accon afd ought not to have
        and Maintaine agt. the Said Deft. for yt. the Said Deft: Sayth
        that Since the plaintfs Issuing out his originall writt
        agt. the Said Deft: to wit on the nineth day of June Anno Dmi
        1702 he the Said Defendt. Accounted with a certaine Edwd. —
        Stevenson and David Wilson who was book keeper or agent
        for the Sd. Edwd. Fry and Edwd Stevenson and that at the ==
        day afd ye. Said Edwd Deft: did pass his obligation under hand
        And Seale to the Said Fry and Stevenson or one of them who
        then Seemed to be Joyntly Concerned in their business for the Sume
        of four hundred fifty Seven pounds of tobaco as pr a rect. here
        in Court brought will Appeare being the balle. of all
        Accounts between Sd Fry Stevens & Said Defendt: and of this —
        puts himself upon the Countrey ~ ~
