                               Septr. Court. 1702
      to our Sovñ Lord the King for a certaine Invry retd. into the office
      for probatt of wills and granting Adndcon upon the Estate of —
      John Whittall late of the afd County decd yt. then this prsent
      Obligation to be void and of none effect otherwise to stand and —
      remaine in full force power Strength and Vertue ~
                And thereupon prays leav to Imprle untill next Cort which is
      granted him. the Same day is given ye. plf also ~
                Att which Said next Court Comes as well the plaintf by his attry
      Afd As the deft. by his Sd Attry Who further defends the force and
      Injury when &ca: And for plea Sayth that the Said plaintf his
      Accon afd agt. him this Deft ought not to have because he Sayth
      yt. the Sd. John Holinsworth after the Making the writing afd —
      here in Court brought was not in any Manner damnified ——
      by reason of the afd writing obligatory passd. to or So our [?]
      Sovereign Lord the King in the Endorsment afd Above Specifyed
      in which the Sd. John Hollinsworth for a certaine Invry retd. —
      into the office for probatt of wills and granting Adndcon upon
      the estate of the Said John Whittall late of the afd County decd
      was bound And this he is ready to Averr and thereupon prays
      Judgt. if the plaintf his accon afd to have and Maintaine ought
      &ca. Macklin pr Dte-& ye. plf in like Manner Earle pr qr- ====
             And no where this twenty Second day of Septr. Anno Dmi 1702
      The pleadings and Allegacons on both Sides being this Court
      heard weighed and Maturely deliberated it is by them Justices —
      Considered yt. the Said John Hollansworth take nothing by his
      Writt afd but be in Mercy for his false Clamour And yt. the
      Sd John Chamney Admr. as afd go thereof without day and
      it is likewise Considered by the Court ye. day and year last —
      Menconed yt the Sd. John Champney Admr. of Sd Wm. Brereton
      Recover agt. the Said John Hollinsworth ye. Sume of three —
      hundred and twenty nine ==== pounds of tobacco for his Costs &
      Charges in this behalf laid out and Expended &ca:
